MINUTES <br />City Council <br />Jan. 14, 1987 <br />Allen Scalze suggested that the City Attorney research the matter and <br />Avenue determine what the County would do in the case such as this where <br />Right-Of-I~ay the adjacent property owner did not want the vacated property. <br />(Cont.) <br />Tarnowski stated that he purchased his property with the understanding <br />that the right-of-way for Allen Avenue was 66 feet, and he does not <br />want a portion of this right-of-way vacated. <br />Fahey pointed out that it has been City policy not to keep property <br />unnecessarily and to get it back on the tax rolls for the benefit <br />of all the taxpayers in the City. However, the Mayor felt that the <br />City Attorney should make a determination as to the actions of the <br />County in this matter. <br />Fahey suggested that the City might want to proceed with the <br />vacation even though P1r. Tarnowski is opposed to it, and pointed <br />out that a subsequent property owner may want the property in <br />order to divide the lot. However, Fahey stated that he was willing <br />to table the matter for a month pending a determination by the <br />City Attorney. <br />Mr. Hammer, 2995 Greenbrier, adjacent property owner to Allen <br />Avenue, stated that he was opposed to the vacation. Hammer <br />questioned whether his property could be divided as his house is <br />placed towards the back of the lot. <br />Mr. Blesener pointed out that the Hammer property is 100 feet wide <br />and there is enough square footage available to divide the lot without <br />the 8 feet of Allen Avenue proposed to be vacated. <br />There was no one else present from the general public wishing to <br />be heard on this matter. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-1-15 - CLOSING THE <br />PUBLIC NEARING ON THE PROPOSED VACATION <br />OF A PORTION OF THE ALLEN AVENUE RIGHT- <br />OF-WAY <br />The foregoing resolution was duly seconded by Mr. LaValle. <br />Ayes (5) Blesener, Collova, LaValle, Scalze, Fahey. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Qook No. 17, Page 15. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />Page -3- <br />
