MINUTES <br />City Council <br />Jan. 14, 1987 <br />Allen <br />Avenue <br />Right-Of-Way <br />(Cont.) <br />Lakeview <br />Estates <br />Agenda <br />Item No. 5 <br />Re~-~~jrre~tion <br />1 5 <br />RESOLUTION N0. 87-1-16 - TABLING ACTION ON <br />TNE PROPOSED VACATION OF A PORTION OF THE <br />ALLEN AVENUE RIGHT-OF-WAY UNTIL THE <br />FEBRUARY 11, 1987 COUNCIL MEETING <br />The foregoing resolution was duly seconded by Mr. Collova. <br />Ayes (5) Fahey, Collova, Scalze, Blesener, LaValle. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 17, Page 16. <br />Mr. Gordy Howe, developer of the Lakeview Estates plat, appeared <br />before the Council and informed them that the County is requesting <br />10 feet of additional right-of-way from the Lakeview Estates plat <br />along Edgerton. As a result, Mr. Howe would like the Council's <br />feelings about a 10 foot frontyard setback variance for the <br />homes he proposes to construct on this property. Howe pointed <br />out that the homes would g1-ike up with existing homes on Edgerton. <br />tine <br />Fahey asked why the County would request the 10 additional feet <br />when all the other property along Edgerton is already developed. <br />Mr. Howe stated that they are making the request in the event that <br />Edgerton would ever have to be widened. <br />Scalze asked if the proposed homes could be setback further than <br />20 feet from the road right-of-way. <br />Mr. Howe replied that they could not due to the topography of the <br />property. <br />Fahey felt that a variance was warranted in this case as the <br />applicant would be deprived from rights that other property owners <br />along Edgerton have. Fahey stated that he would like to see the <br />proposed homes line up with the existing homes on Ed.gerton. <br />Scalze pointed out that the topography of the property would be a <br />justification for granting the variance. However, Scalze stated <br />that she would like to know the frontyard setbacks of existing <br />homes on Edgerton. <br />Mr. Blesener agreed that a hardship was present to warrant granting <br />a variance. <br />Fahey suggested that Mr. Howe make formal application for his <br />variance request. <br />Page -4- <br />
