MINUTES <br />City Council <br />Jan. 28, 1987 <br />Hardy PLANNING COMMISSION TO ALLOW 52 RETAIL <br />CUP (Cont.) SALES PER YEAR ON-SITE AND CONSIDERING <br />THE HARDY CONDITIONAL USE PERMIT AS <br />THE SECOND USED CAR SALES LICENSE IN THE CITY <br />The foregoing resolution was duly seconded by Mr. Fahey. <br />Ayes (5) Blesener, Fahey, Scalze, Collova, LaValle. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 17, Page 34. <br />Klein The City Clerk reported that a letter was sent to Mr. McCulloch <br />Fence requesting that he correct the fence along his north property <br />Matter line in a manner that would satisfy Mrs. Klein's wishes. The <br />letter stated that if Mr. f4cCulloch disagreed with this request, <br />Agenda he should appear at tonight's meeting. Mr. McCulloch is not <br />Item No. 13 present. <br />Fahey suggested that since it is obvious that Mr. McCulloch does <br />not disagree with the request, that the Building Inspector should <br />be advised to contact Mr. McCulloch requesting the time table for <br />correction of the fence. <br />Mrs. Klein was concerned that this matter has been dragging on <br />for many months and requested that the Council take action to <br />resolve the issue. <br />Fahey stated that the City will follow up with the Building Inspector <br />contacting McCulloch and will report to Mrs. Klein. Fahey suggested <br />that the matter be put back on the agenda for the february 11 meeting. <br />Council and Mrs. Klein again discussed that fact that Mrs. Klein <br />wants the McCulloch fence to match the fence along her north <br />property line. Klein stated that the fence is to be chain-link <br />from the back of her house forward to Rice Street, however, she <br />may be willing to compromise that the fence can be chain-link <br />from the front of the McCulloch building forward to Rice Street. <br />Scalze pointed out that at a previous Council meeting Mr. McCulloch <br />was given until June 1 to resolve the fence matter. McCulloch may <br />be assuming that the June 1 date still applies. <br />The Planner informed the Council that his letter to Mr. McCulloch <br />informed him that the fence should be corrected immediately and <br />that June 1 no longer applied. <br />Klein again stated that the matter has dragged on too long and <br />felt that she was not being treated fairly. <br />Page -11- <br />
