MINUTES <br />City Council <br />Feb. 11, 1987 <br />Pull-Tabs SOCIETY FOR THE PAST YEAR SHOWING <br />St. Joseph's THE EXPENDITURES OF MONIES RECEIVED <br />Society <br />(Cont.) The foregoing resolution was duly seconded by Mr. Fahey. <br />Ayes (4) Blesener, Fahey, Scalze, Collova. <br />Nays (1) LaValle. <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 17, Page 53, <br />LaValle reported that he voted against this license, as he believes <br />the City should be consistent in the information it is requesting <br />of applicants for gambling licenses, and a deviation has been made <br />in this instance. <br />Vacation Of The City Attorney reported that he has reviewed the plat of the <br />Portion Of Belland Addition, which includes the portion of Al1en Avenue that <br />Al1en Avenue the City is considering vacating. It appears that the property <br />Right-Of-Way on either side of the centerline of Allen Avenue would accrue to <br />the adjacent property, namely Lot 15 and Lot 1. The Attorney <br />Agenda reported that it is his conclusion that the fee title of the 8 feet north <br />Item No. 9 of Allen Avenue right-of-way being consider for vacation would lie <br />with the o4mer of Lot 15, namely Mr. Don Tarnowski. <br />The City Engineer reported that he has reviewed the Tarnowski and <br />Hammer properties and has determined that with the vacation of <br />Allen Avenue as proposed these properties would have adequate <br />square footage to be able to divide into two lots. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-2-52 - BRTNGING TO TABLE <br />THE PROPOSED VACATION OF A PORTION OF <br />ALLEN AVENUE RIGHT-OF-WAY <br />The foregoing resolution was duly seconded by Mr. Collova. <br />Ayes (5) Fahey, Collova, LaValle, Blesener, Scalze. <br />Nays (0). <br />Resolution declared adopted. <br />7his resolution appears in Resolution Book No.17, Page 54. <br />Mr. Tarnowski reported that he has hired legal counsel and that <br />he intends to pursue the matter in order to prevent the City from <br />requiring his acceptance of the vacated portion of Allen Avenue. <br />The City Attorney reported that the Council must make a determination <br />whetheror not it is in the public interest to vacation this portion <br />of Allen Avenue. <br />Page -13- <br />
