MINUTES City Council Feb. 11, 1987 Tulgren Blesener pointed out that the City now has a liquor license available Liquor that it could either hold on to in the event a hotel or large License restaurant were developed in the City, or the City could accept (Cont.) applications from the general public for this license. Fahey asked if the City were obligated to issue the license to Mr. Tulgren. The City Attorney replied that this City was not tied to issuing the license to Tulgren. The release submitted by Michael Boyle only requests that the license be rescinded, and does not request the a new license be issued to Tulgren. However, the City does have an application for the license made by Tulgren. Scalze pointed out that the City could go to the State Legislature and request an additional liquor license, should a hotel or restaurant development approach the City with a request for a liquor license. Fahey pointed out that Mr. Tulgren is assuming that this is a routine matter and that he will be issued the liquor license. The City Attorney pointed out that the original action was a request by Mr. Tulgren to transfer the Boyle license to Tulgren. However, the State Department of Revenue said that this license was subject to unpaid sales taxes and the City did not have the power to transfer. The obligation to pay the State sales tax would carry over with the license if it were transferred. Therefore, Mr. Boyle submitted a statement requesting that the liquor license be rescinded. Mr. Greg Tulgren appeared before the Council and reported that his father has paid the water bill that was due on the property. Also, Tulgrens have been working with the City to get the liquor license back in their possession. LaValle felt that the City had an obligation to issue the license to Tulgren and pointed out that they have run a good establishment in the City for many years. LaValle pointed out the City's option of requesting the State Legislature for additional liquor licenses. Tulgren reported that the business was sold to Michael Boyle, and due to problems, the Tulgren's now have the business back. Tulgren pointed out that they have an empty building sitting on Rice Street and need the liquor license. Mr. Blesener stated that he just wanted to make the Council aware of its options. Collova asked if the City has obtained a police report on the principals requesting the license. The City Clerk reported that the police report has been received and it is satisfactory. Page -15-
