MINUTES <br />City Council <br />Feb. 11, 1987 <br />Tulgren Blesener pointed out that the City now has a liquor license available <br />Liquor that it could either hold on to in the event a hotel or large <br />License restaurant were developed in the City, or the City could accept <br />(Cont.) applications from the general public for this license. <br /> Fahey asked if the City were obligated to issue the license to Mr. <br /> Tulgren. <br /> The City Attorney replied that this City was not tied to issuing the <br /> license to Tulgren. The release submitted by Michael Boyle only <br /> requests that the license be rescinded, and does not request the <br /> a new license be issued to Tulgren. However, the City does have <br /> an application for the license made by Tulgren. <br /> Scalze pointed out that the City could go to the State Legislature <br /> and request an additional liquor license, should a hotel or restaurant <br /> development approach the City with a request for a liquor license. <br /> Fahey pointed out that Mr. Tulgren is assuming that this is a routine <br /> matter and that he will be issued the liquor license. <br />The City Attorney pointed out that the original action was a request <br />by Mr. Tulgren to transfer the Boyle license to Tulgren. However, <br />the State Department of Revenue said that this license was subject <br />to unpaid sales taxes and the City did not have the power to transfer. <br />The obligation to pay the State sales tax would carry over with the <br />license if it were transferred. Therefore, Mr. Boyle submitted a <br />statement requesting that the liquor license be rescinded. <br />Mr. Greg Tulgren appeared before the Council and reported that his <br />father has paid the water bill that was due on the property. Also, <br />Tulgrens have been working with the City to get the liquor license <br />back in their possession. <br />LaValle felt that the City had an obligation to issue the license <br />to Tulgren and pointed out that they have run a good establishment <br />in the City for many years. LaValle pointed out the City's option <br />of requesting the State Legislature for additional liquor licenses. <br />Tulgren reported that the business was sold to Michael Boyle, and <br />due to problems, the Tulgren's now have the business back. Tulgren <br />pointed out that they have an empty building sitting on Rice Street <br />and need the liquor license. <br />Mr. Blesener stated that he just wanted to make the Council aware <br />of its options. <br />Collova asked if the City has obtained a police report on the <br />principals requesting the license. <br />The City Clerk reported that the police report has been received <br />and it is satisfactory. <br />Page -15- <br />
