MINUTES <br />City Council <br />Feb. 25, 1987 <br />Klein/ <br />McCulloch <br />Fence <br />Matter <br />(Cont.) <br />Klein again expressed concern for the barbed wire on top of the <br />fence. <br />Fahey asked the Code requirements for this. <br />The Planner replied that a fence in a commercial area can have <br />barbed wire as long as it is on an arm extending inward towards <br />the property. <br />Klein reported that the barbed wire is straight up from the fence. <br />Menk replied that the barbed wire will be changed to be in compliance <br />with Code requirements. <br />Scalze asked how difficult it would be to change the boards on the <br />fence to a basketweave design. <br />Menk replied that the basketweave design is not acceptable for <br />security reasons, and also pointed out that a different, more <br />flexible type of board would be needed for a basketweave design. <br />Menk reported that the insurance company for the property is also <br />opposed to the basketweave design. <br />Fahey indicated that McCulloch feels that the fence he built, <br />other than it facing the wrong direction, is in compliance with <br />what the Planner requested and with City Ordinance. <br />Scalze questioned when the City uses the screening provision in the <br />ordinance and when the fencing ordinance is used. Scalze pointed <br />out that the two do not always mean the same thing. <br />Fahey felt that the issue was if the Council knew that Mrs. Klein <br />wanted a basketweave design, would it have required this of Mr. <br />McCulloch or been persuaded by his argument that the basketweave <br />design posed a security problem. Fahey pointed out that the fence <br />meets code subject to being turned around. Also the City Attorney <br />indicated that the City does not have a legal basis for requiring <br />McCulloch to chanqe to hasketweave. Fahey felt that he could not <br />support Mrs. Klein's request or justify a 1awsuit against Mr. <br />McCulloch. <br />Klein felt that Mr. Fahey was backing down from his previous <br />position. <br />Blesener stated that he was willing to stick to the agreement the <br />City had with Mr. McCulloch on December 10, 1986 requiring that <br />the fence be turned around and chain-link be installed on the <br />front portion of the fence. Also, barbed wire on the fence should <br />meet City Code requirements. <br />Page -7- <br />
