MINUTES <br />City Council <br />March 25, 1987 <br />Report On The City Planner reported that there has been a long-standing concern <br />Setbacks over the size of sideyard setbacks in R-1 areas. Current ordinance <br />requires these setbacks to be 10 feet. However, prior to October 14, <br />Agenda 1964 these setbacks were 5 feet. The confusion lies in whether the <br />Item No. 10 setbacks for property platted and developed prior to the effective <br />date of the new ordinance are 5 feet or 10 feet. <br />The Planner suggested that the wording of the ordinance be revised to <br />specifically refer to the date of October 14, 1964. Also the present <br />ordinance refers to platted lots, and the City has lots that were not <br />platted. The Planner suggested that the ordinance refer to lots <br />which are legally divided. The Planner also suggested that the word <br />"developed" be changed to "upon which a single-family house has been <br />constructed". <br />Scalze stated that it was her understanding that if a house was constructed <br />prior to 1980, an addition to the house could be 5 feet from the lot <br />line. Scalze felt that this was the understanding of most residents <br />of the City. <br />Fahey agreed. <br />Blesener indicated that if this has been the past practice in the City, <br />the policy should remain consistent. <br />The Planner asked the Council's feelings for detached, accessory <br />buildings. The Planner pointed out that accessory buildings have <br />more flexibility for placement on a lot. <br />The Council agreed that the setback for accessory buildings should <br />be 10 feet, while the setback for additions to homes constructed <br />prior to 1980 should be 5 feet. <br />>~ or are preparing ordinances <br />Sale Of Mrs. Scalze pointed out that other cities have ordinances in effect~: <br />School dealing the the preservation of School park and recreational faciTities <br />Buildings as part of the City's park system when a school building is sold. <br />Agenda Mrs. Scalze introduced the following resolution and moved its adoption: <br />Addition <br />RESOLUTION N0. 87-3-123 - AUTHORIZING THE ~< <br />t~.
