MINUTES <br />City Council <br />April 22, 1987 <br />Gary Meise Fahey opened the public hearing on the request of Gary P4eise, 2992 <br />CUP For Vanderbie, to construct a 512 square foot accessory building on his <br />Accessory property. Fahey noted that the Planning Commission has recommended <br />Building approval subject to the recommendations contained in the Planner's <br />report dated April 7, 1987. <br />Agenda <br />Item No. 5 There was no one present from the general public wishing to comment <br />on the Meise CUP request. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-4-151 - CLOSING THE <br />PUBLIC HEARING ON THE GARY MEISE REQUEST <br />FOR CONDITIONAL USE PERMIT TO CONSTRUCT <br />AN ACCESSORY BUILDING <br />The foregoing resolution was duly seconded by Mr. Collova. <br />Ayes (5) Blesener, Collova, Fahey, Scalze, LaValle. <br />Nays (0), <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 17, Page 164. <br />Blesener pointed out that the Meise garage is 580 square feet and <br />the proposed accessory building would be 512 square feet. <br />The Planner stated that 1,000 square feet is the total square <br />footage allowed for accessory uses. However, the Meise garage <br />is not considered an accessory use. A conditional use permit is <br />required as the accessory use exceeds 120 square feet. <br />Blesener expressed concern about Mr. Meise's indication that one <br />of the uses of the accessory building would be to raise homing <br />pigeons. Blesener was concerned that this could become a public <br />nuisance. <br />The Planner reported that he has discussed this with the Building <br />Inspector and there is no prohibition in the ordinance regarding <br />raising homing pigeons. <br />Fahey suggested that the conditional use permit could be revoked <br />should a public nuisance occur. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-4-152 - APPROVING THE <br />CONDITIONAL USE PERMIT REQUEST BY GARY MEISE <br />FOR CONSTRUCTION OF A 512 SQUARE FOOT ACCESSORY <br />BUILDING AT 2992 VANDERBIE WITH THE RECOMMENDATION <br />THAT IF THE STATED USE OF RAISING HOMING PIGEONS <br />BECOMES A PUBLIC NUISANCE, THE CUP WILL BE <br />REVOKED UNTIL SUCH TIME AS THE NUISANCE IS <br />CLEANED UP, AND FURTHER SUBJECT TO THE <br />Page -2- <br />
