MINUTES <br />City Council <br />April 22, 1987 <br />Meise CUP <br />Becker Lot <br />Split and <br />Sideyard <br />Variance <br />Agt~nda <br />Item No. 6 <br />RECOMMENDATIONS OF THE CITY PLANNER <br />AS CONTAI~IED IN HIS APRIL 7, 1987 <br />REPORT <br />The foregoing resolution was duly seconded by Mr. Fahey. <br />Naes (pj Blesener, Fahey, Collova, Scalze, LaValle. <br />Y <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 17, Page 165. <br />Mr. Fahey opened the public hearing on the Oliver Becker request <br />for a lot split and sideyard setback variance for his property <br />located at 551 Allen Avenue. Mr. Becker would like to divide <br />a 75 foot lot from his property, which would result in necessity <br />for a five foot sideyard setback variance from Becker's existing <br />home. <br />Fahey outlined the Planning Commission's action with regard to <br />this proposal which resulted in the Commission voting 4 to 3 to <br />recommend approval. The Planner has recommended denial as there <br />is no factual finding to warrant the variance. Fahey also noted <br />that the City has a letter on file from Robert Rudolph, an adjacent <br />property owner, opposing the lot split and variance. <br />The Planner explained the proposal to the Council noting that <br />originally the City's thoroughfare plan proposed a road adjacent <br />to the Becker property. When Becker purchased the property, there <br />was a 30-foot road easement across it, and as the adjacent house <br />was too close to the lot line, the City anticipated having to <br />acquire an additional 30 feet of road easement from Becker for <br />the street if ever developed. When Becker requested a building <br />permit for the property, the City required that he set his house <br />back a certain amount of feet from the property line in anticipation <br />of the road being approved. Becker originally planned to place <br />the house in the middle of the lot. <br />Becker agreed with the Planner's statement and noted that he placed <br />his house 80 feet from the property line. However, the road was <br />never put in and in 1982 the City vacated this road. <br />Fahey reviewed copies of the minutes of the October 30, 1972 Council <br />meeting at which the Becker property was discussed. Fahey did not <br />feel that the variance that was granted Becker at this time has any <br />bearing on the current proposal. <br />Becker indicated that since the City forced him to locate his house <br />where he did, and now the road has been vacated, he should be allowed <br />to use the property. <br />Page -3- <br />
