PnINUTES <br />City Council <br />April 22, 1987 <br />Fill Permit The Planner reported that the Corps of Engineers classifies an <br />(Cont.) area by vegetation type and not necessarily the presence of cattails. <br />Mr. Harry Kath pointed out that there is currently fill available due <br />to the work on the railroad property. Kath felt that the matter <br />should be expedited so that Fuel Economy could take advantage of <br />this free fill. <br />Fahey suggested that the Engineer expedite the matter and if after <br />reviewing the situation, feels that the filling was acceptable, <br />Fuel Economy could proceed without Council action. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-4-165 - ALLObIING THE ENGINEER <br />TO AUTHORIZE THE CONTINUATION OF THE FILLING <br />PROCESS REQUESTED BY FUEL ECONOMY UPON CLEARANCE <br />WITH THE ARMY CORPS OF ENGINEERS AND THE ENGINEER'S <br />REVIEW OF THE DRAINAGE SITUATION, AND IF THE MATTER <br />IS NOT RESOLVED BY THE ENGINEER, IT SNOULD BE <br />BROUGNT BACK TO THE COUNCIL IN THREE WEEKS FOR <br />CONSIDERATION OF FURTHER STEPS NECESSARY BY WAY <br />OF DRAINAGE EASEMENTS OR STORM SE6JER <br />The foregoing resolution was duly seconded by Mr. Blesener. <br />Ayes (5) Fahey, Blesener, LaValle, Collova, Scalze. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 17, Page 179. <br />Bingo Mr. Fahey reported that at the previous Council meeting, the Council <br />License requested verification from the State Gambling Control Board that <br />Renewals LCCB's Hall Association was legal and proper under State Statute. <br />LCCB It is the City Attorney's position that the Hall Association is <br />not an appropriate entity under State Statute. <br />Agenda <br />Item No. 15 Fahey also reported that the City has received a written request <br />from Mr. Grey on behalf of Minnesota Registry of Interpreters <br />of the Deaf that the Council reconsider its recent action to <br />veto their gambling license renewal application. <br />Fahey felt that the procedure to take was to first consider the <br />renewal of the other charities, namely St. Joseph's Society, <br />Servants of Mary, Humane Society, North Suburban DAC and Lions <br />Club. If these licenses are approved, then the Council could <br />entertain a motion to reconsider its action with regard to P1RID, <br />however, the motion needs to be made from a Councilmember on the <br />prevailing end of the motion to deny. <br />Fahey noted the copies of the letters the City received from <br />Mr. Richard Wylie to the City Attorney dated April 22, 1987 <br />as well as from Wylie to Roger Franke dated April 22, 1987. <br />Page -23- <br />
