MINUTES <br />City Council <br />April 22, 1987 <br />Soo Lane The foregoing resolution was duly seconded by Mr. LaValle. <br />(Cont.) Ayes (5) Fahey, LaValle, Scalze, Collova, Blesener. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 17, Page 178. <br />Fuel Mr. Jim Ryder of Fuel Economy appeared before the Council requesting <br />Economy approval of a fill permit. <br />Fill Permit <br /> The Engineer reported that it is possible that the fill would <br />Agenda increase the run-off into the Ryan Industrial Park as well as the <br />Addition Frattalone property and Schrier property. The Engineer stated that <br /> the drainage in the area is already critical and this filling could <br /> add to the problem. The Engineer reported that it may be necessary <br /> that the applicant will need a permit from the Army Corps of <br /> Engineers. <br /> Ryder reported that there are no cattails on the property and no <br /> standing water. Ryder disagreed that the area was a wetland and <br /> did not feel either the DNR or Army Corps of Engineers needed to <br /> be involved. <br />The Engineer reported that the DNR already indicated that a permit <br />is needed from the Corps of Engineers. The Engineer reported that <br />he advised that before the Council issued a permit, the Corps of <br />Engineers permit be obtained. <br />Ryder pointed out that Fuel Economy has been paying taxes on the <br />property, and did not feel that Fuel Economy had to maintain a <br />ponding area for other properties. If this is the case, the City <br />should condemn the property and take it over as a drainage area. <br />Fahey stated that this is what the City may have to do. However, <br />felt the Engineer should review the drainage of the area in more <br />detail before making a recommendation. <br />The Engineer agreed that a longer look needed to be taken of the <br />drainage of the area. <br />Scalze asked which properties are draining into this area. <br />The Engineer felt that the property east of the railroad was <br />draining into the area. <br />Ryder felt that only the Fuel Economy property was draining into <br />this area. <br />The Engineer pointed out that this request was only received on <br />Friday, and he would like an opportunity to review it further. <br />Scalze stated that she looked at the property and did not see any <br />cattails. <br />Page -22- <br />
