MINUTES <br />City Council <br />April 22, 1987 <br />6ingo with initial rents charged to the charities. <br />(Cont.) <br />Fahey stated that he can accept the position of Mr. blylie that <br />the charities are better off negotiating as a group with Mr. <br />Short rather than individually. However, this does not answer <br />the question of whether or not the set up is legal. <br />Scalze pointed out that if the charities negotiated individually <br />with Short, the problems would be between Short and the charities. <br />Fahey stated that he was content that the Hall Association format <br />was an efficient way to operate, but that he had to be convinced <br />on its legality, and if that means that the Hall must close down <br />for a period of time in order to get an opinion from the State, <br />he was prepared to do it. Fahey felt that the City had a right <br />to expect guidance from the State and get some answers out of <br />them. <br />Blesener stated that if the City does not deny the licenses, it <br />will get nothing out of the State. Blesener pointed out that <br />the State has only taken token action so far, and if the City <br />approves the license, the State will also and worry about the <br />problem next year at renewal time. Blesener pointed out that <br />it is up to the State to regulate and they are not doing their <br />job. Blesener stated that until the State does its job, he does <br />not care to have bingo. <br />Fahey also pointed out Tom Short's recent remarks that he would <br />accept applications for leases from the individual charities, and <br />agreed that some of the charities might be left out if they have <br />to negotiate with Short individually. <br />LaValle stated that he was not in favor of one or two people <br />controlling the employment at the Hall for six charities. <br />Fahey felt that if the situation was legal, the City should not <br />worry about it. Fahey also pointed out that an audit is required <br />every year and this should provide the City with a certain comfort <br />level. <br />Fahey pointed out that Bob Finnerty obtains his livelihood selling <br />gambling devises and felt his position on the Board put him in a <br />position to monopolize products. <br />Wylie indicated that Bob Finnerty will resign immediately if the <br />Council desires. <br />LaValle did not think this was the time for Bob Finnerty to resign. <br />Wylie noted that Mr. Finnerty has never voted on lease matters. <br />Fahey suggested that for purposes of discussion the Council accept <br />that Finnerty has resigned, however, there is still the Hall <br />Association matter to deal with. <br />Page -27- <br />
