MINUTES <br />City Council <br />April 22, 1987 <br />Bingo Blesener stated that he had other questions regarding compliance, <br />(Cont.) depositing of money into one bank account and then later <br />distributing funds, and other questions which were raised by <br />the City Auditor. <br />Scalze stated that the City does not know if the charities are <br />in compliance or if the Hall Association allows them to come <br />into compliance by devious methods. <br />Fahey stated that he would be willing to call a special meeting <br />to reconsider the license applications if the City receives an <br />opinion from the State. <br />Collova asked when the 30 day time limitation for the City to <br />act is up. <br />The Clerk estimated the time limit to be May 5. <br />Wylie noted that the City Attorney indicated that the State may <br />have an opinion within the 30 day time period. Wylie suggested <br />that the City Attorney and Mayor request a formal opinion from <br />the State, and this might speed things up. <br />Scalze was concerned that just submitting the names of Board <br />members to the State was not enough and that personal information <br />and biographies were needed. <br />Fahey asked if applications would have to be resubmitted if the <br />Council takes action to deny tonight. <br />It was indicated that this is correct. <br />Fahey stated that he would prefer to deny the licenses and put <br />the burden on the charities. <br />Fahey suggested that Wylie could provide more detailed information <br />on the Board members and suggested that the City Attorney could <br />write to Roger Frank informing him of the structure of the Hall <br />Association and asking if it was his opinion that the structure <br />complies with State Statute. The Attorney could inform Franke <br />that the license applications were denied as it was the Attorney's <br />opinion that the structure did not comply with State law. However, <br />the City would reconsider the licenses upon confirmation from <br />Franke's office that the structure was legal. <br />LaValle reported that he would not be in favor of the license <br />applications if LCCB is structured as it is presently. <br />Fahey again pointed out that if the structure is legal, the <br />City should not be concerned with it. <br />Page -28- <br />
