MINUTES <br />City Council <br />April 22, 1987 <br />Becker Lot FOR ADOPTION WHICH GRANTS A 5-FOOT <br />Split SIDEYARD SETBACK IN SOME SPECIAL CASES <br />(Cont.) FOR HOMES BUILT PRIOR TO 1980 AND SUBJECT <br />TO THE SUBMISSION OF A SURVEY INDICATING <br />THAT THERE IS THE AMOUNT OF FOOTAGE AS <br />INDICATED BY MR. BECKER <br />The foregoing resolution was duly seconded by Mr. Collova. <br />Ayes (3) alesener, Collova, LaValle. <br />Nays (2) Fahey, Scalze. <br />Motion denied. <br />This resolution appears in Resolution Book No. 17, Page 167. <br />Boosalis Mr. Fahey opened the public hearing on the Boosalis request for <br />CUP & PUD conditional use permit and PUD for construction of a gas station/ <br />for Gas convenience store at the corner of Rice Street and County Road C. <br />Station/ Fahey reported that the Planning Commission voted 5 to 2 to recommend <br />Convenience approval subject to the conditions as outlined in the Planner's <br />Store report dated April 2, 1987. <br />Agenazl Mr. Nick Boosalis, developer, appeared before the Council and <br />Item No. 7 outlined the proposal which includes 1,300 square feet for a <br /> convenience center and an additional 10,000 square foot retail <br /> center. Boosalis pointed out that part of the property is set <br /> aside in an outlot, and no approvals are being requested on this <br /> portion of the property. <br /> Boosalis reported that his firm is a real estate builder and owner, <br /> and he has contacted between 400 and 500 users and the only anchor <br /> tenant interested is a gas station/convenience store. <br />Boosalis described the curb cuts and pointed out that they are seeking <br />an easement for a shared drive with the animal hospital to access the <br />back lower level of the proposal. <br />Scalze asked plans for the green area shown on the proposal. <br />Boosalis stated that to the best of his knowledge it would remain <br />green as there is limited potential for this property. <br />Scalze pointed out the property to the north and suggested that <br />this would be a good use of tax increment financing if this property <br />could be combined and developed with the Boosalis property. <br />Boosalis replied that there is a limited amount of developable area <br />on the property to the north, even if combined with his parcel. <br />Fahey asked Boosalis if he would be willing to dedicate the green <br />area shown on the plat as an outlot to the City to be used for <br />drainage purposes. <br />Page -6- <br />
