MINUTES <br />City Council <br />P9ay 27, 1987 <br />Bingo Pew reported that the Judge may grant a new trial in the unlawful <br />(Cont.) detainer action or it may be that any lease arrangement between <br /> the parties may be dismissed. The matter is still in litigation. <br />Pew also reported that there are conditions in the lease which <br />prevent LCCB from assigning thelease without the approval of <br />Movers Warehouse. It may be that assignment of the lease to a <br />trustee without the financial responsibility for the terms of <br />the lease would not be in the landlord's best interest and would <br />not be approved by the landlord. <br />Pew reported that the difference between the first and second lease <br />is the payment for certain improvements, the conducting of concessions <br />and the term of the lease is longer. <br />Pew reported that Servants of Mary and St. Joseph's Society feel that <br />the terms of the direct lease are more favorable that the lease with <br />LCCB as the charities are paying more to LCC6 than to Tom Short. <br />Tom Short reported that he and St. Joseph's Society and Servants of <br />Mary have a meeting of the minds with regard to the lease issue. <br />However, there is no such situation between Short and LCCQ or some <br />of the charities making up LCCB. Short also pointed out that the <br />other charities have not approached him with regard to individual <br />leases. <br />Pew reported that after Junel none of the individual charities will <br />be license~ and rent checks will probably not be forwarded to LCCB. <br />4lylie reported that the lease with Tom Short requires mutual consent <br />to assign a lease, however, the lease has not been assigned. LCCB <br />continues to operate as landlord. LCCB is the same corporation <br />however, its functions have been limited to that of landlord. ldylie <br />also pointed out that P1r. Short wants to litigate the unlawful detainer <br />action here tonight after having lost once. Wylie stated that with <br />regard to the appeal, the Judge may also decide that she was correct <br />the first time and not change her mind. This is a strong possibility. <br />tJylie stated that if the Movers lviarehouse lease is not better than <br />the previous leases, it seems unusual that Mr. Short would spend <br />quite a bit of time and money trying to defeat the first lease, and <br />Wylie points out that Short is continuing to try to get the first <br />lease defeated. <br />6Jylie stated that with regard to Mr. Benson's comments regarding the <br />actions of the Gambling Control Board, no individual charity has been <br />asked to submit bank accounts, rather LCCB has been asked to submit <br />these accounts. <br />Blesener stated that by asking LCCB to submit bank accounts, all the <br />charities are being asked. <br />Page -24- <br />
