MINUTES <br />City Council <br />May 27, 1987 <br />Leibel <br />Variance <br />(Cont.) <br />Fahey stated that he felt the variance requested was appropriate. <br />Fahey felt that Larson's request for a privacy fence was over- <br />reaching, and if the property abutted a commercial development <br />it might be another matter. <br />Larson stated that at the time he wrote his letters he was not <br />sure how many homes were proposed for the area, and felt that <br />since only one home is proposed, he was not as concerned with <br />the development as he was initially. However, Larson requested <br />that the driveway easement be paved. <br />Fahey felt that request was reasonable. <br />Leibel requested that paving the easement not be a requirement of <br />the variance. Leibel stated that his brother intends to pave <br />the driveway, but may not be able to do so immediately. <br />Collova asked if the Council could require the easement be paved <br />as part of the variance approval. Collova also asked if the City <br />could require that the house be centered in the property to <br />preclude future requests for lot splits. <br />Leibel reported that his brother plans to center the garage in <br />front of the driveway easement and felt that the house would be <br />centered on the lot line shown on the diagram. <br />Scalze agreed that too much property should not be left so that <br />someone in the future requests a lot split. <br />The Planner pointed out that he is recommending that the property <br />be platted, and as part of the plat the City could require a <br />drainage easement that would preclude a lot split in the future. <br />The City Attorney agreed that the house location could be tied <br />to a diagram and that a drainage easement could be required on <br />the plat to preclude future development. <br />There was no one else from the general public wishing to comment <br />on the Leibel variance request. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-5-228 - CLOSIPIG THE <br />PUBLIC HEARING ODI THE LEIBEL VARIA~ICE TO <br />CONSTRUCT A DPIELLING ON A LOT WITH LESS <br />THA~1 75 FEFT ABUTTING A PUBLIC STREET <br />The foregoing resolution was duly seconded by Mrs. Scalze. <br />Ayes (5) Blesener, Scalze, Collova, LaValle, Fahey. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 17, Page 246. <br />Page -8- <br />
