MINUTES
City Council
May 27, 1987
Leibel
Variance
(Cont.)
Fahey stated that he felt the variance requested was appropriate.
Fahey felt that Larson's request for a privacy fence was over-
reaching, and if the property abutted a commercial development
it might be another matter.
Larson stated that at the time he wrote his letters he was not
sure how many homes were proposed for the area, and felt that
since only one home is proposed, he was not as concerned with
the development as he was initially. However, Larson requested
that the driveway easement be paved.
Fahey felt that request was reasonable.
Leibel requested that paving the easement not be a requirement of
the variance. Leibel stated that his brother intends to pave
the driveway, but may not be able to do so immediately.
Collova asked if the Council could require the easement be paved
as part of the variance approval. Collova also asked if the City
could require that the house be centered in the property to
preclude future requests for lot splits.
Leibel reported that his brother plans to center the garage in
front of the driveway easement and felt that the house would be
centered on the lot line shown on the diagram.
Scalze agreed that too much property should not be left so that
someone in the future requests a lot split.
The Planner pointed out that he is recommending that the property
be platted, and as part of the plat the City could require a
drainage easement that would preclude a lot split in the future.
The City Attorney agreed that the house location could be tied
to a diagram and that a drainage easement could be required on
the plat to preclude future development.
There was no one else from the general public wishing to comment
on the Leibel variance request.
Mr. Blesener introduced the following resolution and moved its adoption:
RESOLUTION N0. 87-5-228 - CLOSIPIG THE
PUBLIC HEARING ODI THE LEIBEL VARIA~ICE TO
CONSTRUCT A DPIELLING ON A LOT WITH LESS
THA~1 75 FEFT ABUTTING A PUBLIC STREET
The foregoing resolution was duly seconded by Mrs. Scalze.
Ayes (5) Blesener, Scalze, Collova, LaValle, Fahey.
Nays (0).
Resolution declared adopted.
This resolution appears in Resolution Book No. 17, Page 246.
Page -8-
