MIDIUTES <br />City Council <br />June 10, 1987 <br />Bingo LaValle asked about Legislative changes regarding lawful expenses. <br />(Cont.) <br />Babel reported that the State recently changed laws which now make <br />it easier for the charities to be in compliance, as the majority of <br />charities were not meeting compliance ratios. <br />Benson reported that his two charities were willing to rotate, and <br />the only condition they would request is that the charities operate <br />similar games. The games should be consistent and not competing <br />a~i th each other. <br />Benson reported that another point for consideration is that LCCB has <br />not signed a release agreement for the lease they hold, and this needs <br />to be taken care of. <br />Benson stated that any charity that signs a lease with Movers tdarehouse, <br />must agree to rotating nights on a reasonable basis. <br />Fahey felt the terms of the lease LCCB holds says that the lease will <br />cease to exist if the particular charities making up LCCB are not <br />licensed. After June 1 these charities were no longer licensed, <br />and Fahey indicated that he was comfortable that the LCCB lease is <br />now dead. <br />The City Attorney agreed and indicated that it is the obligation of <br />the State Garobling Control Board to review the lease and determine <br />if it is adequate. Secondly, the LCCB lease question may be resolved <br />in a court, however, it is not the Council's responsibility to resolve <br />this issue. <br />Dick Pillsbury, representing Servants of Mary, reported that he has <br />been negotiating the lease for his charity and has spent a lot of <br />time on the lease and stated that he put a lot of weight on P1r. Babel's <br />advice. Servants of Mary feels the lease is acceptable and have <br />negotiated changes in the lease uiith Mr. Short. Pillsbury also indicated <br />that Servants of Mary is willing to negotiate a rotation that is <br />equitable and will operate in the spirit of cooperation. <br />Fahey asked Servants of Mary their feeling if the charities cannot <br />agree to a rotation, if the City sets up the rotation. <br />Pillsbury felt that the charities will be able to handle this issue <br />themselves and pointed out that they understand the compliance issue <br />and the importance of compliance to the charities. Also, if there is <br />a problem with the amount of rents being charged, the charities have <br />the option of going to the State Gambling Control Board and appealing. <br />P1r. Rick 4lylie, attorney representing DAC, Lions, Humane Society, and <br />MRID, reported that he is encouraged by Mr. Benson's comments that <br />his charities will cooperate and rotate on an equitable basis. <br />Wylie felt that it would be better to negotiate the rotation first <br />rather than rely on the willingness of the charities to negotiate. <br />Wylie stated that he would like a formal agreement on rotation. <br />Page -5- <br />
