MINUTES <br />City Council <br />July 22, 1987 <br />4dright Wright informed the Council that it is on record that an easement <br />Property was to have been obtained from the Plessel property for Noel Drive. <br />Division Wright also pointed out that he is the majority property owner in <br />(Cont.) the area, and if the City will not allow Noel Drive to be improved <br /> and obtain the necessary easements, his property will be landlocked <br /> and he should not have to pay taxes on it. <br /> Fahey pointed out that the easement was never filed on the Plessel <br /> property. <br /> The City Attorney reported that when the Plessel's purchased their <br /> property they placed their house anticipating that Noel Drive would <br /> be improved some day. However, Mrs. Plessel wants to be compensated <br /> for the easement property. <br /> Fahey reported that if Mr. Wright convinces the Council that the City <br /> should put in the road, the cost of the project would be assessed <br /> against the benefit properties. <br /> Wright felt that the Plessel's should be compensated for the easement <br /> based on the value of the land, not the $17,000 to $20,000 they are <br /> requesting. <br /> Mr. Wright also indicated that he would like to put in the improvement <br /> himself, and would follow the specifications of the City Engineer. <br />Fahey pointed out that the easement is needed to put the road in, <br />and the City has the power of condemnation which Mr. Wright does not. <br />Fahey suggested that either 4lright negotiate with Mrs. Plessel or <br />petition the City to put the improvement in. The cost of any easement <br />that would be acquired would be assessed against the benefited properties. <br />6~right asked if the City would act on his lot split request. <br />Fahey replied that once the easement is obtained and dedicated to the <br />City, the lot split can be acted upon. <br />Fahey suggested that the Council call for the public hearing and <br />in the meantime Mr. Wright can submit a petition to the City for <br />the improvement. <br />Scalze pointed out that a temporary cul-de-sac would be installed <br />at the end of the street. <br />The City Clerk noted that the Plessel property could not be assessed <br />as it is a corner lot and already has utilities. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-7-351 - CALLING FOR A <br />PUBLIC NEARING FOR THE IMPROVEMENT OF NOEL <br />DRIVE IN CONJUNCTION WITH THE DAVID WRIGHT <br />Page -30- <br />
