MINUTES
City Council
August 26, 1987
Assessment McTeague asked if he would have to accept a variance if it were
Hearing imposed on his property.
Imp. No.
86-15 Scalze asked how much of a variance would be necessary.
(Cont.)
f4cTeague replied that if he had a 30 foot backyard on his existing
home, about a 500 square foot variance would be needed to get a
buildable lot. However, P4cTeague stated that he would not be
satisfied with a 30 foot backyard and would want a larger yard.
Fahey suggested that the assessments could be deferred and the
City would wait and see if the property develops. Fahey then
commented that if P1cTeague requested a reasonable variance to
develop the property which was denied by the Council, he N~ould
have grounds to request the assessments be deleted.
It was the concensus of the Council that a deferment should be
granted for the assessments to the McTeague property.
Mrs. Jackie Brandt, 2573 Stark Street, asked if interest accrued on
deferred assessments.
alesener reported that after September 25 interest would accrue
on assessments, including any that were deferred.
Brandt requested a deferment of her assessments because due to her
garage location, her property could not be split without moving the
garage.
Fahey noted that the garage could be moved in order to make the
property dividable.
Blesener reported that he looked at the property and it appeared to
him that there was adequate room to divide the property without
moving the garage. Blesener noted that the setback for a detached
garage was 10 feet. Blesener suggested that the Engineer look at
the property.
Brandt questioned why she should be assessed for the Lake Street
property which the City vacated, particularly the 10 feet over which
the City has an easement.
Fahey pointed out that Brandt owns the property, the City has only
retained an easement for drainage and utilities.
Fahey also pointed out that Brandt was one of the parties requesting
that Lake Street be vacated.
Brandt stated that if Lake Street had been vacated 8 years ago, she
would not be complaining.
Page -21-
