MINUTES <br />City Council <br />Sept. 23, 1987 <br />Slumberland The Planner replied that the developer is required to keep the street <br />(Cont.) clean. <br />The City Clerk reported that the Public Works Superintendent has <br />informed the owners that they must sweep the street, or else the <br />City would hire a contractor and do the job and bill them for the <br />cost. <br />Stenger also reported that there is a great deal of clay now on the <br />shoulders of the road which have caused the shoulders to become very <br />slippery. Stenger felt that the entry to the site should be blacktopped <br />so that mud and clay are deposited onto their property. <br />Scalze pointed out that the excavation is not completed and the <br />developer will not want to do any blacktopping until that time. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-9-444 - INSTRUCTING THE <br />PUBLIC WORKS SUPERINTENDENT TO ADVISE <br />SLUMBERLAND THAT PURSUANT TO THEIR DEVELOPMENT <br />AGREEMENT LJITH THE CITY AND PURSUANT TO CITY <br />ORDINANCES, THE CITY REQUESTS TNAT THEY TAKE <br />ADEQUATE MEASURES TO CONTROL DUST AND DEBRIS <br />ON CENTERVILLE ROAD, AND FAILURE TO DO SO WILL <br />RESULT IN THE CITY'S HIRING A CONTRACTOR TO <br />REMOVE THE QY-PRODUCTS OF THEIR CONSTRUCTION <br />IdITH THE COST TO BE ASSESSED AGAIPIST THE <br />SLUMBERLAND PROPERTY <br />The foregoing resolution was duly seconded by Mrs. Scalze. <br />Ayes (5) Fahey, Scalze, Collova, LaValle, Blesener. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 18, Page 469. <br />Mr. Larry Hartmann, 466 Allen Avenue, reported that trucks from the <br />Slumberland site were driving across farm fields and exiting on <br />Allen Avenue. Nartmann also complained about the dust from the <br />project and the debris that was deposited onto Allen Avenue. <br />It was pointed out that the trucks were stopped from using Allen <br />Avenue. <br />Collova felt that the Public l~orks Superintendent should look at <br />the street, and, if in his opinion, it needs to be cleaned, Slumberland <br />should be requested to do so, otherwise the City will hire a contractor <br />and bill the cost to the property owner. <br />Fahey agreed that the Public Works Superintendent should use his <br />judgement in this matter. <br />Page -7- <br />
