MINUTES <br />City Council <br />Sept. 23, 1987 <br />Bloomquist and there is no easement filed for that pipe. Therefore, the Ganzel's <br />Addition maintain that the City of Little Canada is in trespass and utilizing <br />Easement their property to their detriment. <br />Matter <br />(Cont.) The City Planner reported that he met with Mr. Kelly and it appears <br />the storm sewer pipe was installed in 1979 and the easement for the <br />pipe was never filed. <br />The City Clerk agreed that the easements were drawn, but never filed <br />against the property. <br />Mr. Fahey suggested that the City Attorney and City Engineer work with <br />the Ganzel's on this matter and resolve the situation to their satis- <br />faction. <br />Kelly reported that the Ganzel's would like to begin construction of <br />a home this fall on the property and their architect has indicated <br />that the best location for their home would be about 20 feet from the <br />pipe. The Ganze1's are concerned about the hazard that this pipe <br />might represent. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-9-443 - INSTRUCTING THE <br />CITY ATTORNEY AND CITY ENGINEER TO REVIEW <br />THE LEGALITY OF THE EASEMENT IN THE BLOOM- <br />QUIST ADDITION AND INSTRUCTING THE CITY ENGINEER <br />TO WORK 41ITN THE PROPERTY OWNERS INVOLVED ON THE <br />RELOCATION OF THE EASEMENT THAT WILL BE SATISFACTORY <br />TO ALL PARTIES INVOLVED AND REQUESTING THE ENGINEER <br />REPORT BACK TO TNE COUNCIL AT TNE NEXT REGULAR <br />COUNCIL MEETING <br />The foregoing resolution was duly seconded by Mr. Blesener. <br />Ayes (5) Fahey, Blesener, Collova, LaValle, Scalze. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 18, Page 468. <br />Slumberland Mr. Bill Stenger, Jr., 3032 Centerville Road, appeared before the <br />Dust and Council to complain about a dust and debris problem caused by <br />Debris trucks hauling from the Slumberland site. Stenger pointed out <br />Problem that there are 40 to 50 trucks per day hauling from the site onto <br />Centerville Road and when soil is wet, it is being deposited onto <br />Agenda Centerville Road. When it rains, the soil then becomes very slippery <br />Addition causing a hazard on the street. Stenger reported that when the soil <br />is dry, there is a terrible dust problem. <br />Stenger asked if in the Development Agreement with the contractor, <br />there is provision for dust control measures to be taken. <br />Page -6- <br />
