AS SUB~9ITTED AND RECOMMENDED BY TNE CITY <br />ATTORNEY A~ID AUTHORIZING THE MAYOR AND CITY <br />CLERK TO SIGPI THE EASEMENT AGREEMENT ON <br />BEHALF OF THE CITY <br />The for•egoing r•esolution was duly seconded by Mr•. Collova. <br />Ayes (5) Scalze, Collova, Blesener•, LaValle, Fahey. <br />Nays (0). <br />Resolution declar~ed adopted. <br />This r•esolution appear~s in Resolution Book No. 18, Page 560. <br />Liquor• The City Attorney submitted for~ Council consider•ation a pr~oposed <br />License ordinance that would author•ize the sale of str•ong beer~ at an <br />Or•dinance establishment alr•eady licensed to sell 3.2 beer• and wine. The City <br />Attor•ney r~epor~ted that the State Legislatur~e has decided that any <br />Agenda hol der• of a 3.2 beer• and wi ne 1 i cense can sel l str~ong beer• wi thout <br />Addition an additional license being r•equir•ed fr•om the municipality. However~, <br />dr•am shop insur•ance is r•equir•ed to sell str~ong beer•. <br />The City Attor~ney pointed out that the City does not have to enact <br />the or•dinance allowing the holder~ of a 3.2 beer• and wine license <br />to sell str•ong beer•, however~, if the City does allow it, an additional <br />municipal license is not r•equir•ed. <br />Mr•. Blesener• suggested that the Council r•eview the pr•oposed ordinance <br />with action to be taken at the next Council meeting. <br />The City Cler~k pointed out that the only businesses in the City that <br />this or~dinance will effect is Tr•ovar•e's, U. S. Swim & Fitness, <br />and the For•tune Cookie Inn. <br />Fahey felt that given the limited number• of business the or•dinance <br />will effect, and the fact that dr•am shop insur•ance was r~equired <br />for~ those businesses selling str•ong beer•, that the or•dinance should <br />be adopted. <br />Mr~. Fahey intr~oduced the following r•esolution and moved its adoption: <br />ORDINANCE ~10. 290 - AN ORDINADICE ADDING <br />SECTION 703.180 AUTHORIZING THE ON-SALE <br />OF INTOXICATING MALT LIQUOR <br />The for•egoing or•dinance was duly seconded by Mr~s. Scalze. <br />Ayes (3) Fahey, Scalze, Collova. <br />Nays (2) Blesener, LaValle. <br />Or~di nance decl ar~ed adopted. <br />Blesener~ and LaValle wanted additional time to r•eview the or~dinance <br />befor•e acting upon it. <br />Page -25- <br />
