LaValle. <br />Ayes (4) Scalze, LaValle, Collova, Fahey. <br />Nays (1) Blesener•. <br />Resolution declar~ed adopted. <br />This r~esolution appears in Resolution Book No. 18, Page 601. <br />Mor•avetz Mr~. Milan Mor•avetz, 476 Al1en Avenue, has submitted a letter• to the <br />Request To City r•equesting the exclusive use of the public easement for• Noel <br />Use Vacant Dr•ive adjacent to his pr~oper~ty. Mor~avetz r•epor•ted that he is pr•esently <br />Str•eet maintaining this pr~oper•ty as his own yar•d. <br />Agenda Fahey r•eported that the Mor•avetz request is not in keeping with <br />Item No. 7 the guidelines of the public dedication of a str•eet r•ight-of-way, <br />and that the City could not gr•ant Mor•avetz the exclusive use of this <br />r~ight-of-way unless the City deeded the property to Moravetz. <br />Mr•. Mor~avetz r•epor~ted that he i s havi ng a pr•obl em wi th 3-wheel er•s <br />using the pr•oper•ty. <br />Blesener• r•eplied that this would be a matter• that would fall under• <br />the public safety section of the or~dinance. <br />LaVal l e r~epor•ted that i t i s unl awful for• anyone to oper~ate a 3-wheel er• <br />on pr~oper~ty not belonging to that per•son unless they have the wr•itten <br />per~mission of the proper•ty owner. LaValle suggested that Mor•avetz <br />contact the Sher•iff's Depar~tment, however, pointed out that it is a <br />difficult situation to contr•ol. <br />Fahey r•epor•ted that i t woul d be i nappr•opr•i ate to gr~ant the Mor~avetz <br />r•equest, and pointed out that the City has never• done this in the <br />past because of the natur•e of public easements. <br />Blesener• pointed out that Moravetz can continue to use the pr•oper•ty <br />as his yar•d. <br />Huonder• Mr•. Gr•egor~y Huonder•, r•epresenti ng hi s si ster, Kathl een Huonder•, <br />Fill Per•mit appear•ed befor~e the Council r•equesting a fill per•mit for• a lot <br />1 ocated on Lakeshor•e Avenue and Lake Str•eet. Nuonder• r~epor~ted that <br />Agenda soil cor•r•ections ar•e needed on the pr~oper•ty befor•e a home can be <br />Addition built on it. <br />Huonder~ r•epor•ted that the lot is Lot 6 and abutts Savage Lake. <br />Nuonder• also r~epor•ted that he has been in contact with the DNR <br />and Water~shed r•egar~ding the filling, and they have indicated that <br />the City's Shor•eline Or~dinance should be followed. <br />page -5- <br />
