MINUTES <br />City Council <br />Dec. 30, 19II7 <br />Buche Lot Blesener~ asked if the str•eet cul-de-sac was located on Tr•act A. <br />Split <br />(Cont.) The Engineer• r~eplied that the cul-de-sac was within str•eet r~ight-of- <br />way. <br />Scalze noted that the pr~oper•ty to the south of the Buche pr~oper•ty <br />appear•s to be wet. <br />The Engineer• agr~eed that the pr•oper•ty was wet and did not think this <br />property could be developed. <br />Fahey suggested that if that is the case that the Sixth Avenue r~ight- <br />of-way be vacated and the City r~eser•ve a utility and dr•ainage easement. <br />The Engineer• pointed out that the str•eet r~ight-of-way for• Sixth Avenue <br />was only 30 feet wide. <br />Scalze noted that the easement on the Buche pr•oper~ty is identified as <br />a utility easement and asked if the City would have pr•oblems if it <br />stor•ed snow on the easement. <br />The Engineer• did not think so noting that the cul-de-sac is slightly <br />less than standar~d size and within the r•ight-of-way. The Engineer <br />also pointed out that if the wor~d "str•eet" wer~e added to the title <br />of the easement, someone might assume that the str•eet could be <br />impr~oved. The Engineer~ felt that the easement was identified adequately <br />as it is. <br />Blesener~ pointed out that Mor•r•ison Avenue has a 66 foot easement. <br />Mr•. Blesener• intr•oduced the following r•esolution and moved its adoption: <br />RESOLUTIOP! N0. 87-12-586 - APPROVING THE BUCHE <br />LOT SPLIT AS SUBMITTED IN THE SURVEYS CONTAINED <br />IN THE COUNCIL'S ADDITIONS TO TfiE AGENDA <br />The for•egoing r•esolution was duly seconded by Mr•. LaValle. <br />Ayes (51 alesener•, ~aValle, collova, Fahey, Scalze. <br />Nays (0). <br />Resolution declar•ed adopted. <br />This r~esolution appear•s in Resolution f3ook No. 18, Page 635. <br />Sounding Fahey r~epor•ted that the City Cler•k has contacted the Soo Line Railr•oad <br />Of Tr~ain r~egar•ding the sounding of whistles within City limits and was infor~med <br />Whistles that ver~y few municipalities have enacted or~dinances pr~ohibiting the <br />sounding of whistles within their• limits. The Cler~k has also discussed <br />Agenda the matter• with the City's insur~ance company and they have r•ecommended <br />Ii.em No. 9 that the City not adopt an or~dinance pr•ohibiting blowing of whistles <br />within the City. <br />Page -8- <br />
