MINUTES <br />City Council <br />Mar•ch 9, 1988 <br />Capitol holding an open house fr•om 2:30 P.M. until 7 P.M. and invited ever•yone <br />Community to attend. <br />Services <br />Special fahey r•epor•ted that the City has r•eceived a special cr~ime bulletin from <br />Cr•ime the Ramsey County Sher~iff's Depar•tment r~egar~ding a suspect vehicle <br />Bul l eti n which i s an ol der• Chevr~ol et Van wi th a 12-i nch hor~i zontal r~ed str•i pe <br />along the side as well as mar•oon pr•imer~. The last thr•ee digits of the <br />license number ar~e 851. The Sher•iff's Depar~tment has asked that anyone <br />seeing this vehicle please contact the Department. <br />Public Fahey opened the public hear•ing on the r~equest of Richar•d Schr•ier• for~ <br />Hear~ing an amendment to a conditional use permit to constr~uct an 8-plex on <br />CUP his tr~iangular•-shaped pr~oper~ty located at the inter~section of Old <br />Amendment County Road C and ~lew County Road C. <br />R. Schr~ier• <br /> Fahey pointed out that this hear•ing was continued fr~om the last Council <br />Agenda meeting at which time the City Attor•ney, City Planner• and Mr•. Schr•ier• <br />Item No. 5 wer~e to r~esear•ch thei r~ r~ecor•ds to deter•mi ne whether• or• not the PUD <br /> for• the Schr•ier• pr•oper~ty located acr•oss the str~eet was extended to <br /> include the triangular parcel as well. Fahey reported that the City <br /> Planner~ has repor~ted that his r•ecor•ds to not indicate that the PUD <br /> was extended. The City Attor•ney also indicated that he has no r~ecor~d <br /> of the PUD being extended to include the tr~iangular• parcel. <br />Fahey r~eviewed the Planner•'s r•eport r•ecommending that the Schr~ier~ <br />parcel r•eceive appr•oval for~ a development density of up to 6 units. <br />Mr•. Richar~d Schr~ier~ appear~ed befor•e the Council and r~epor•ted that when <br />the City downzoned his pr•oper•ty fr•om R-3 to R-2, it was downzoned for• <br />townhouse use. Schrier reported that his attorney, Mr. Daubney, represented <br />him, but could not be pr•esent this evening as he is out-of-town. <br />Schr•ier• r•epor~ted that the Council pr•eviously appr•oved a conditional use <br />per~mit for• an 8-unit building on this site and he was assur•ed by Dave <br />Licht, the City Planner•, that the PUD on his pr•oper•ty acr~oss the str•eet <br />would be extended to include this par•cel and the conditional use per•mit <br />would then be good for• a per•iod of 10 year~s. Nowever~, now Mr•. Licht has <br />stated that he has no r•ecollection of those comments. <br />Schr~ier• also r~epor•ted that the City Cler•k has indicated that he was of <br />the impr~ession that the 10-,year agr~eement applied to the tr•iangular <br />par•cel as well. Schr~ier• r•epor•ted that he r•elied on this infor•mation, <br />other•wise he would have built the 8-plex when it was fir•st appr~oved <br />by the Council. <br />Schreir reported that he is before the Council now asking for an amend- <br />ment to the conditional use per•mit so that he can change the entr•ance <br />to the site for• health-safety r•easons, pointing out that an entr•ance <br />on Mew County Road C would be hazar•dous. <br />page -3- <br />
