Fahey intr~oduced the following r~esolution and moved its adoption: <br />RESOLUTION N0. II8-3-84 - CLOSING THE <br />PUBLIC HEARING ON THE RICHARD SCHRIER <br />REQUEST FOR CONDITIONAL tISE PERMIT <br />AMENDMENT <br />The for~egoing r~esolution was duly seconded by P~r•. Blesener•. <br />Ayes (5) Fahey, Blesener, Scalze, Collova, LaValle. <br />Nays (0). <br />Resolution declar~ed adopted. <br />This r~esolution appear~s in Resolution Book No. 19, Page 88. <br />Council discussed the fact that the $250 paid by Mr•. Schr~ier• at the <br />time he applied for~ the CUP amendment should be r•etur~ned as the CUP <br />has become null and voitl and, ther~efor•e, an amendment is not possible. <br />Fahey poi nted out that accor•di ng to Ci ty r~ecor~ds ther~e i s no agr~eement <br />for• an extension of the one year~ time per~iod for• acting upon a conditional <br />use per~mit. <br />Mr•. Fahey intr•oducetl the following r~esolution and moved its adoption: <br />RESOLUTIOPJ N0. 88-3-85 - DENYING TNE RICFiARD <br />SCHRIER REQUEST FOR CONDITIONAL USE PERPIIT <br />AMEPIDMEPIT FOR THE TRIA~IGULAR-SHAPED PROPERTY <br />AT OLD COUNTY ROAD C AND NE4d COU~ITY ROAD C <br />ON THE BASIS THAT THE ORIGINAL CONDITIONAL USE <br />PERMIT REQUEST AND APPROVAL HAS LAPSED PURSUANT <br />TO CITY ORDINANCE ~10. 921.030 (c) WHICH RELATES <br />TO THE LAPSE OF APPROVAL IF THE CUP IS NOT ACTED <br />UPO~I I~ITHI~I ONE YEAR, APID INDICATI~IG THAT THE <br />PROPER PROCEDURE WOULD BE FOR P1R. SCHREIER TO <br />SU[~MIT A NEW APPLICATION A~ID SITE PLA~I FOR THE <br />PROPFRTY FOR DEVELOPP~IENT OF THE SITE IN EXCESS <br />OF A DUPLEX, AND HEREBY INSTRUCTI~IG THE CITY <br />CLERK TO REFUND MR.
