MINUTES <br />City Council <br />May 25, 1988 <br />David OF A DEDICATED 100 FOOT BY 20 FOOT ROAD <br />Wr~ight EASEMENT FROM ALLEN AVENUE TO THE NORTH <br />Pr•oper~ty PROPERTY LINE OF THE WRIGHT PROPERTY AND <br />Division SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS <br />(Cont.) OF THE CITY PLANNER AS CONTAINED IN HIS REPORT <br />DATED MAY 5, 1988 <br />The for~egoing resolution was duly seconded by Mr~. LaValle. <br />Ayes (5) Fahey, LaValle, Collova, Scalze, Blesener~. <br />Nays (0). <br />Resolution declar•ed adopted. <br />This r~esolution appear~s in Resolution Book No. 19, Page 208. <br />The Ci ty Attor•ney noted that Mr~. Wr•i ght wi 11 be r~esponsi bl e for• fi 1 i ng <br />the deed r•estriction as pr•ovided for• in the Planner~'s r•epor•t. <br />Blesener• questioned the need for• a deed r•estr•iction, noting that once <br />the 20 foot easement is dedicated, the City Codes will addr~ess the <br />issue of no building per•mit until r•oad fr~ontage is impr•oved. <br />The Council discussed this and agr~eed that the deed r•estr•iction was not <br />necessar•y at it pertained to the dedication of the r•oad r•ight-of-way <br />and not the building per~mit issue which is alr•eady addr•essed by City Code. <br />Mr•. Blesener~ intr•oduced the following r~esolution and moved its adoption: <br />RESOLUTION N0. 88-5-207 - RESCINDING <br />RESOLUTION N0. 88-5-205 <br />The foregoing r•esolution was duly seconded by Mr•. Fahey. <br />Ayes (5) Blesener•, Fahey, Scalze, LaValle, Collova. <br />Nays (O1. <br />Resolution declar•ed adopted. <br />This resolution appear~s in Resolution Book No. 19, Page 209. <br />Mr~. Fahey intr•oduced the following r•esolution and moved its adoption: <br />RESOLUTION N0. 88-5-208 - APPROVING THE DAVID <br />WRIGHT PROPERTY DIVISION AS PRESENTED SUBJECT <br />TO THE FOLLOWING: THAT A 100 FOOT BY 20 FOOT <br />ROAD EASEMENT FOR NOEL DRIVE BE DEDICATED <br />EXTENDING FROM ALLEN AVENUE SOUTH TO THE PROPERTY <br />IN QUESTION AND SUBJECT TO THE RECOMMENDATIONS OF <br />THE CITY PLANNER EXCLUDING THE DEED RESTRICTION, <br />AND FINALLY SUBJECT TO THE DEDICATION OF THE <br />NECESSARY DRAINAGE AND UTILITY EASEMENTS AS <br />DETERMINED BY THE CITY ENGINEER <br />Page -10- <br />
