MORATORIUM IN THE EVENT THAT A PUBLIC <br />HEARING IS DETERMINED NECESSARY <br />The for•egoing r•esolution was duly seconded by Mr•s. Scalze. <br />Ayes (4) Fahey, Scalze, Collova, Blesener. <br />Nays (0). <br />Resolution declar•ed adopted. <br />This r•esolution appear•s in Resolution Book No. 19, Page 256. <br />Blesener~ suggested that once the mor~ator•ium is in place, the Council <br />could act on the concept approval. <br />Fahey suggested that the matter~ would be on the next Council agenda <br />if a public hear•ing is not necessar•y. Otherwise, the matter~ would <br />be consider~ed at the second meeting in July. <br />Mr•. Blesener• intr•oduced the following r•esolution and moved its adoption: <br />RESOLUTION N0. 88-6-252 - TABLING ACTION ON <br />THE BWANA ARCHERY P.ANGE CONCEPT PROPOSAL <br />UNTIL SUCH TIME AS IT IS DETER~9INED WHETHER <br />OR NOT A PUBLIC HEARING IS REQUIRED FOR THE <br />DEVELOPMENT MORATORIUM FOR COUNTRY DRIVE AND <br />UNTIL COUNCIL ACTS ON THE DEVELOPMENT P90RATORIUM <br />ORDINANCE TO BE PRESENTED [3Y THE CITY ATTORNEY <br />The for~egoing r~esolution was duly seconded by Mr•s. Scalze. <br />Ayes (4) Blesener~, Scalze, Fahey, Collova. <br />Nays (0). <br />Resolution declar•ed adopted. <br />This r•esolution appear•s in Resolution Book No. 19, Page 257. <br />Car•la Fahey r•epor•ted that the City has r•eceived a petition fr~om the proper•ty <br />Lane owner•s on Car~la Lane requesting water•main and str•eet impr~ovement. <br />Impr•ovement Fahey reported that since the petition is signed by mor•e than 35% <br />Petition of the pr~oper•ty owner•s involved, the Council is obligated by State <br />Law to order~ a feasi bi 1 i ty r~eport. The Ci ty Engi neer• woul d pr•epar~e <br />the r~epor•t which will provide cost estimates for• the impr~ovement. <br />Once the feasibility repor~t is r•eceived, and if the pr~oject is <br />feasible, the City Council would then call a public hearing to <br />consider• the impr~ovement. If water•main impr•ovement is appr•oved, <br />a joint power~s agreement will have to be enter~ed into with the City <br />of Maplewood for• the extension of their watermain. <br />Page -10- <br />
