MINUTES <br />City Council <br />June 22, 1988 <br />Taco Holland reported that there are three properties involved,comprising the <br />John's Taco John's site and these three par•cels ar•e owned by differ•ent par•ties. <br />(Cont.) <br />Scalze asked if there was enough squar•e footage so that setback r~equir•ements <br />could be met. <br />The City Planner~ r•eported that the Taco John's building is located on <br />one lot and par•ts of two other~ lots ar~e being used for• parking. The <br />Planner• r~epor~ted that there ar~e ser~ious non-confor~mities on the site <br />cur~r•ently, and under• or•dinance, the Taco John's building would only be <br />allowed to be r•emodeled. The Planner~ stated that the City has the <br />option to r•ezone the pr•operty and allow the constr•uction of the new <br />facility, or• the City can just allow the building to be r•emodeled. <br />Fahey stated that he under•stood the pr•oblem was that ther•e was a non- <br />confor~mi ng use i n an i ndustr~i al ar~ea. He was not aware that var•i ances <br />would be needed to meet setbacks. <br />The Pl anner• stated that i f the Ci ty r~ezoned the pr•oper•ty, the proper~ty <br />owner• could pur•sue land acquisition and combine the lots and then request <br />a conditional use permit for~ a restaurant. However, if the proper•ty owner• <br />can not acquir~e the additional pr•oper•ty, the City could rezone the area <br />and gr•ant setback and lot size var~iances and gr•ant a CUP for~ off-site <br />parking. A thir~d option would be to just r~emodel the existing building. <br />Bob Schmidt, r•epr~esenting Taco John's, r~epor~ted that some of the land <br />they would like to acquir•e is owned by the County and he is concer•ned <br />that the County would not sell this pr~operty. <br />Fahey pointed out that the City has not granted variances for~ other• <br />pr•operty owners who have wanted to expand, but their~ pr~oper~ty has been <br />too small. <br />Schmidt r~epor•ted that Taco John's will pur•sue the pur•chase of additional <br />pr•oper•ty, but wanted to know the City's position on rezoning. <br />Fahey stated that he saw no pr•oblem with the r~ezoning since a B-3 zone <br />made mor~e sense than Industr•ial in that par~ticular~ ar~ea given the <br />sur•rounding uses. However•, Fahey felt Taco John's would need additional <br />pr•oper•ty in or~der• to meet setbacks. <br />The City Planner• pointed out that the Compr•ehensive Plan recommended <br />B-3 zoning for this ar~ea, however•, the area was never~ rezoned. <br />It was the concensus of the Council that the rezoning was appr•opr~iate, <br />however, Taco John's would need to acquir•e additional pr~oper~ty so that <br />the pr•oposed building would meet setback r~equirements. <br />Saiko The City Engineer• r•epor•ted that he is pr•oposing that an 18-inch, plastic <br />Dr~ainage pipe be installed along Sylvan Avenue and across Day Avenue to dr•ain <br />sur~face water• coming fr~om the tr~ailer~ cour~t.
