MINUTES City Council June 22, 1988 Schroeder Propewty Division (Cont.) The Planner• r•eplied that it could not. Scalze asked if an agr•eement between the City and Schr•oeder~ for~ platting of the pr~oper~ty at a later date would be enfor•ceable. The Ci ty Attor~ney r•epl i ed that the agr•eement woul d have to be r•ecor~ded against the pr~oper•ty. Fahey noted that if the pr•oper•ty is platted, and Par•cel 1 is platted as an outlot, the road easement would not have to be dedicated at this time. P1r. Blesener~ intr•oduced the following r•esolution and moved its adoption: RESOLUTION N0. 88-6-249 - APPROVIDIG THE SCHROEDER PROPERTY DIVISION AS REQUESTED WITHOUT THE ROAD EASEMENT BEING DEFINED AT THIS TIME, SUBJECT TO THE PARK COMMISSION'S REVIEW OF APPROPRIATE PARK CHARGES, AND WITH TNE STIPULATION THAT TNE PROPERTY OWNER ENTER INTO AN AGREEMENT WITH TNE CITY THAT AT THE TIP+IE THERE ARE DEVELOPMENT PLANS FOR PARCEL 1, OR PARCEL 1 IS SOLD, THE PROPERTY bIILL BE PLATTED duly seconded by Mr~. Collova. This r•esolution appear•s in Resolution Book No. 19, Page 254. The for•egoing r~esolution was Ayes (2) Blesener•, Collova. Nays (2) Scalze, Fahey. Resolution denied. Mr~. Fahey intr•oduced the following r•esolution and moved its adoption: RESOLUTION N0. 88-6-250 - APPROVING THE SCHROEDER SUBDIVISION REQUEST SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE CITY PLANNER AS COPlTAINED IN HIS MEMO DATED JULY 2, 1987 WHICH REQUIRES THE PLATTING OF THE PROPERTY AS WELL AS OTHER CONDITIONS AND REQUIRING THAT THE BALANCE OF PARCEL 1 QE PLATTED AS AN OUTLOT WITH FUTURE LOCATION OF THE ROAD TO BE DETERMINED WHEN TNAT PROPERTY DEVELOPS The for•egoing resolution was duly seconded by Mr•s.
