Terms and conditions contained in that <br />Property pur•chase agreement ar•e consistent with those made on other• pr•operties <br />(Cont.) pur•chased by the City in the Center~ville Road ar•ea. <br />Mr. Blesener intr~oduced the following r•esolution and moved its adoption: <br />RESOLUTION N0. 88-7-280 - AUTHORIZING THE <br />MAYOR AND CITY CLERK TO SIGN THE PURCHASE <br />AGREEMENT FOR THE AIC PROPERTY AS SUBMITTED <br />BY THE CITY ATTORNEY WHICH INCLUDES THE SAME <br />PURCHASE TERMS AS WERE OFFERED OTHER PROPERTY <br />OWNERS 6Y THE CITY FOR THEIR PROPERTY IN THIS <br />AREA <br />The foregoing r•esolution was duly seconded by Mrs. Scalze. <br />Ayes (5) Blesener•, Scalze, Fahey, LaValle, Collova. <br />Nays (0). <br />Resolution declar•ed adopted. <br />This resolution appears in Resolution Book No. 70, Page 285. <br />Spooner~ The City Attor•ney r~epor•ted that he has submitted conveyance documents to <br />Par•k the Registr•ar• of Titles for~ Spooner~ Par•k for• review in anticipation of <br />Pur•chase pr~oblems with r~ecording the title. The Deputy Examiner• feels ther~e is an <br />incorrect legal descr•iption on the abstr•act of one par•cel and a Tor•r•ens <br />Agenda pr~oceedi ng i s necessar•y to cor•r•ect. <br />Addition <br />The Attorney reported that he has a meeting scheduled with the Examiner~ <br />of Titles tomor~row on the matter•, and the Examiner has the power• to overr•ule <br />the Registrar of Titles. <br />The Attorney fur•ther• reported that while the City's pur~chase agreement <br />states that the City will purchase the pr~operty north of the tdater~ Wor•ks, <br />it has been deter~mined that the School Distr~icts owns a section of <br />pr~oper•ty beyond this point with the Water• Wor•ks having an easement over~ <br />the pr•operty. It is also necessar~y for~ the City to have a Register•ed <br />Land Survey of the piece it is purchasing and the School District will <br />have to have a Register•ed Land Sur•vey of their• r•emaining pr•oper~ty. <br />The Council felt that the cost of the Register•ed Land Sur•vey for• the <br />por•tion of School pr•oper~ty the City is buying should be the r~esponsibility <br />of the City, but the Register~ed Land Sur~vey for~ the r~emaining School <br />pr•oper•ty should be the r•esponsibility of the School Distr•ict. <br />Fahey indicated that the City's intention was to pur•chase all the School <br />Distr•ict pr•oper•ty located south of Eli Road and the pur•chase price <br />offer~ed the School Distr~ict should include the land with the Water Wor~ks <br />easement over it. <br />Mr~.
