MINUTES <br />City Council <br />Sept. 14, 1988 <br />Gr•abrick Blesener suggested that the solution may be to corr•ect the filling that <br />Fill Permit was done on the corner lot. Fahey agreed that the City should have <br />(Cont.) the excess fill on the corn er lot removed and the lot graded properly. <br /> The run-off problem shoutd not be transferred to another• lot. <br />The City Engineer reported that both the Grabrick lot and the neighboring <br />lot were low and have poor soils. The Engineer felt that the solution was <br />to grade the Grabrick pr•operty so that it dr•ains towards Greenbrier Circle. <br />Grabrick stated that it would be helpful if both lots were filled to the <br />level of County Road B-2. Grabrick reported that the adjacent lot is <br />currently 15 to 18 inches above the level of County Road B-2. <br />The City Engineer• suggested that the excess dir~t in the adjacent lot could <br />be pushed into the Grabrick lot. <br />LaValle agreed that setting the grade of the two lots at the level of <br />County Road B-2 would be a solution to par•t of the problem. <br />Collova agreed, and suggested that the City Engineer look at the site. <br />Collova felt if there was too much fill on the adjacent lot, the excess <br />should be pushed into the Grabrick backyard. <br />Grabrick reported that he will have a surveyor shoot the contour•s of the <br />ar•ea and he would like to fill his backyar•d to the same slope as County <br />Road B-2. Grabrick felt that if the adjacent lot wer•e at this same level, <br />the neighbor•hood would look better. Grabrick estimated that he would <br />need 1,200 to 1,300 cubic yards of fill to get his backyard to the desired <br />level, however, is r•equesting a permit for• 1,000 cubic yards since he <br />will be doing some terracing of his backyard and will get some fill from <br />that. <br />Scalze pointed out that in the past the City has never requir~ed a proper~ty <br />owner• to r~emove fill from his property. Scalze pointed out the filling <br />that was done acr•oss from the Eng proper•ty without a per•mit, and the City <br />did not require this fill to be removed. <br />Blesener• pointed out that in that situation, the City Engineer• did not see <br />a problem with the fill. <br />Mr~. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 88-9-389 - APPROVING THE GRABRICK <br />FILL PERMIT AND GRADING PERMIT SUBJECT TO REVIEW <br />AND APPROVAL OF THE CITY ENGINEER OF A SURVEY <br />SHOWING THE LEVEL OF THE FILL TO BE THE SAME LEVEL <br />AS COUNTY ROAD B-2 AS DESCRIBED BY MR. GRABRICK TO <br />THE COUNCIL, AND INSTRUCTING THE CITY ENGINEER TO <br />WORK WITH THE BUILDING INSPECTOR WITH MR. RYAN, <br />THE PROPERTY OWNER ADJACENT TO MR. GRABRICK, AS <br />WELL AS TO WORK WITH THE CITY ATTORNEY, IF NECESSARY, <br />TO HAVE THE FILL ON THE RYAN PROPERTY RELOCATED OR <br />REMOVED SO THAT IT DOES NOT IMPEDE THE DRAINAGE IN <br />THE NEIGHBORHOOD <br />Page -7- <br />
