MINUTES <br />City Council <br />October 26, 1988 <br />Round Lake Lar~son reported that he has talked with the r~ealtor selling the townhomes <br />Trail about the occupancy per•mits, and he has indicated that he does not tell <br />Townhomes potential buyers that the City has a hold on the permits. <br />(Cont.) <br />Larson also infor•med the Council that his unit did not receive an <br />electr•ical inspection until after it evas completed and he had moved in. <br />Lar•son further expr~essed concer•n about the r•etaining wall and the r•eport <br />the City was to request fr•om the DNR about its condition. <br />Larson reported that the residents of the townhomes do not want any more <br />units occupied until these matters are resolved. <br />Fahey instructed the City Clerk to ask the Building Inspector to r~eview <br />the recor~d of inspectionsfor the townhome development. Fahey also <br />suggested that the suggestion of an unlawful detainer• be looked at. <br />The City Attor~ney suggested that he look into the City's options. The <br />Attorney reported that he has r•eviewed the letter of credit and. it is <br />irr•evocable and assures compliance with the landscaping r•equirements <br />by July l, 1989, other•wise the City can cash in the letter of credit <br />and complete the landscaping. The Attor~ney r~eported that on its face <br />the letter of credit appear~s valid. <br />Fahey suggested that the Development Agr•eement for• the t~wnhomes be <br />reviewed and that the City Staff as well as the City Planner~ look at <br />the plat and put pressur~e on the developer~ to comply with the ter•ms <br />of the Development Agr•eement. <br />McNabb pointed out that it was the Nor•th Subur~ban Company that signed <br />the development agreement for• the project. <br />Fahey suggested that City Staff and consultants begin working on the <br />matter and tr•y to get the problems and concerns resolved. If par•king <br />is located in the wr~ong location, Fahey felt the developer should be <br />made to comply with the site plan. Landscaping and the retaining wall <br />should be addr~essed as well. <br />Larson reported that the sod in the ar~ea of the r~etaining wall is <br />washing into the lake. Ther•e is also the post for~ a deck facing the <br />lake ar~ound which the ground is er•oc~ina and washing away. <br />Fahey suggested that the unlawful detainer be looked into. Fahey <br />r~equested a r•eport from the 6uilding Inspector~ on the status of <br />inspections at the project. Fahey asked if ther~e were any building <br />per•mits which the City could put a hold on. <br />The City Clerk thought that all the townhome building permits had been <br />pulled and ther•e wer•e only single-family permits still outstanding. <br />Mr. Fahey introduced the following r•esolution and moved its adoption: <br />Page -18- <br />
