MINUTES <br />City Council <br />November 23, 1988 <br />Imp. Plo. Fahey asked if ther•e was anyone fr•om the general public pr•esent wishing <br />88-24 to comment on this matter. <br />(Cont.) <br />Russ Fisher, 208 Ryan Drive, appeared before the Council and asked if <br />Ryan Drive was ever~ inspected by the City when it was being constr~ucted. <br />Fahey pointed out that Ryan Drive is not a City road and has never been <br />accepted by the City. <br />Scalze pointed out that the reason the improvement is being considered is <br />because the City has r•eceived a petition signed by 35% of the benefited <br />pr~operty owners requesting the improvement. <br />Fisher• reported that three times he has impr•oved the shoulder~ of the r•oad <br />adjacent to his pr~oper~ty, and the material keeps disappearing. Fisher <br />reported that the entir~e road is disappear•ing. Fisher• questioned the <br />ability of Ar~t Ryan to develop Ryan Industr•ial Park without providing <br />pr~oper• access into the area. <br />Fahey asked the City Engineer for the thinking of the then present Council <br />in allowing Ryan Drive to go in when it would never• meet City specifications. <br />The City Engineer~ reported that the City informed Mr. Ryan that the r•oad <br />would never• meet City standar•ds. The Engineer~ stated that the r~oad was <br />str•ictly an exper•iment to see if it would hold up, pointing out that ther~e <br />i s 30 feet of peat under• that r•oad. <br />Scalze asked Fisher what Ryan told him about the r•oad at the time he <br />pur~chased his lot. <br />Fisher replied that Ryan never said anything about the r•oad. Fisher <br />stated that it was his feeling that the City should never have let Ryan <br />sell any land in the park without pr~oper~ road access. <br />Scalze agreed that it was unfor~tunate that this was done, however•, the <br />pr~esent Council is tr~ying to deal with the situation the best way it can. <br />The City Engineer pointed out that in the past two overlays have been <br />done over~ Ryan Dr~ive. <br />Mr. Roger• Stanke, pr~oper•ty owner• on Ryan Dr•ive, reported that Mr•. Ryan paid <br />for~ those overlays. <br />Fisher stated that he would like to see the road improved, however, did <br />not feel he should have to pay for the cost of doing so. <br />Roger Stanke, 209 Ryan Drive, r•epor•ted that the r•oad condition keeps getting <br />wor~se. Stanke agr~eed that the road needed to be repaired, however~, did not <br />believe he should have to pay for• it. Stanke pointed out that Ryan Dr•ive <br />i s hi s only access to hi s pr~oper•ty. Stanke al so r•epor~ted that ther•e have <br />been some ver•y bad accidents on Ryan Dr•ive. Stanke felt that the road <br />r•epairs should be done right and that Mr. Ryan should pay for them. <br />Page -9- <br />
