MINUTES
City Council
Dec. 14, 1988
~ellular One
(Cont.)
and the City's water tower is 185 feet in height.
Carr•oway stated that if Cellular• One is allowed to place its antenna on top
of the water tower, that would be an even better situation than the mounting
Cellular One is proposing. Carroway suggested that the City Engineer work
with Cellular One to develop a mounting system for this. Car~r~oway reported
that the microwave dish would remain below the bulb of the tank.
Fahey suggested that a$600 per~ month r•ent was fair if Cellular One is
pr~oposing to use the top of the City's water• tower. Fahey also suggested
that any contract contain an escalating provision.
Carr•oway stated that Cellular One would prefer the escalating pr•ovision to
be a five-year term pr•ovision.
Fahey felt that the proposal for• mounting the system on water tower•s was
a creative way of lessening the impact on communities.
Car•roway asked if for~ the $600 fee if Cellular One could have approval for~
up to 9 antenna and 2 micr•owave dishes.
Council discussed this request and it was the concensus that the 6 antenna
proposed was the maximum for the $600 fee, however, the Council was a.greeable
to two microwave dishes. Council ind.icated that in the futur•e if additional
antenna were needed, Cellular One could negotiate that with the City.
The City Clerk r•epor•ted that the City Planner has indicated that a Public
Hearing is necessary since a conditional use per~mit would need to be gr•anted
to Cellular• One for their proposal.
Carroway requested that Cellular• One be able to work with the City Attor•ney
to get the necessary lease agreements drawn up prior to the Public Hear~ing.
The Council was agr~eeable provided that Cellular One understands that they
would proceed at their• own r•isk with the understanding that Cellular One
would bear the cost of any attor•ney fees should the conditional use per•mit
be denied.
Mr. Fahey introduced the following r•esolution and moved its adoption:
RESOLUTION N0. II8-12-530 - CALLING A PUBLIC HEARING
FOR JANUARY 25, 1989 ON THE REOUEST OF CELLULAR ONE
FOR A CONDITIONAL USE PERMIT TO INSTALL SIX-SECTOR
ANTENNA AND TWO MICRObIAVE ~ISHES ON THE CITY'S WATER
TOWER WITH TNE ANTENNA TO BE INSTALLED AT THE TOP
OF THE b1ATER TOI~lER, THE EQUIPMENT TO BE PAINTED TO
MATCH THE TO~rIER AND CELLUTAR ONE TO REIMBURSE THE
CITY AT A COST OF $600 PER MONTH FOR USE OF CITY
PROPERTY
The for•egoing resolution was duly seconded by Mr. LaValle.
Ayes (4) Fahey, LaValle, Collova, Blesener.
Nays (0). Resolution declar•ed adopted.
This resolution appear•s in Resolution Book No. 20, Page 568.
Page -10-
