MINUTES <br />CITY COUNCIL <br />September 18, 1989 <br />position that they do not have a drainage problem, and his <br />development actually decreases the rate of run-off from his <br />site, and the Watershed approves his drainage plan, than <br />there was no need for the storm sewer improvement. <br />Fahey pointed out that the City would still have to acquire <br />the necessary easements for the drainage ditch which flows <br />north. Fahey suggested that the cost of the easement would <br />have to be covered by the Boosalis project and other <br />benefiting properties. Fahey pointed out that Iona Lane is <br />dumping into a ditch for which there is no easement. <br />Scalze suggested that the issue of assessing Iona Lane and <br />any other benefiting properties would have to be addressed <br />at a public hearing. <br />Fahey agreed. <br />Collova asked if the location of the ditch has been <br />determined. <br />Fahey pointed out that since the City has ordered the <br />project, the City Engineer is doing the survey work and will <br />determine if a storm sewer would be located within existing <br />easements. Fahey pointed out that at the current time the <br />ditch is not within an easement and properties are illegally <br />draining into it. Fahey agreed that if a storm sewer <br />project is undertaken, Boosalis and the 7 homes on County <br />Road C should not be the only properties paying for the <br />project since there are other properties that will drainage <br />into it. <br />Fahey asked if there were storm sewer funds available to pay <br />for part of the improvement cost. <br />The Auditor replied that the storm sewer fund has been <br />closed out. However, there is about $45,000 in MSA <br />surpluses available that the City could use. <br />Fahey stated that if the storm sewer project is installed, <br />the City should assess part of the cost to the developer, <br />part to Iona Lane residents and part could come from the <br />surplus MSA monies. Fahey felt that Iona Lane should be <br />assessed since residents are draining into a ditch for which <br />there are no easements. <br />The City Engineer pointed out that when the Saiko project <br />was put in, all benefiting up-stream properties were <br />assessed. <br />Page 5 <br />
