B. Non-Registered Sales Civil Penalty. Any state-licensed cannabis retail business that sells to a <br />customer or patient without a valid local retail registration shall incur a civil penalty of (up to $2,000) <br />for each violation. <br /> <br /> <br />827.040 Limiting of Retail Registrations. <br />The City will not issue more than one (1) cannabis retail registration per 12,500 residents, as <br />determined by the most recent state demographer’s estimate. This cap on registrations does not <br />apply to a medical cannabis combination business with a retail endorsement or a lower-potency <br />hemp edible retailer. <br /> <br />827.050 Local Registration Application. <br />A. Application Submittal. The City of Little Canada shall issue a local retail registration to a state- <br />licensed cannabis retail business that adheres to the requirements of Minn. Stat. 342.22, and which <br />qualifies for a registration under the provisions of Chapter 827. <br />1. An applicant for a local retail registration shall fill out an application form as provided by the <br />City of Little Canada. Information required on the form shall include, but is not limited to: <br />(a) Full name of the property owner and applicant; <br />(b) Address, email address, and telephone number of the applicant; <br />(c) The address and parcel ID for the property which the retail registration is sought; <br />(d) Certification that the applicant complies with the requirements of local ordinances established <br />pursuant to Minn. Stat. 342.13. <br />2. The applicant shall include with the form: <br />(a) The required local registration fee as outlined in Section 827.060(B); <br />(b) A copy of a valid state license or written notice of OCM license pre-approval; <br />(c) A narrative describing the proposed business; <br />(d) A site plan showing the building to house the business, available parking; <br />(e) Floor plans for the proposed business which show compliance to all MN Building Code <br />requirements. <br />(f) A security plan addressing issues surrounding parking, traffic, securing of monetary <br />transactions, any on-site security personnel, building security and alarm systems both internal <br />and external, screening, lighting, window and door placement, landscaping, and hours of <br />operation. <br />(g) A plan for ventilation of the establishment that describes the ventilation systems that will be <br />used to prevent any odor of cannabis off the premises of the business. Such plan shall also <br />include all ventilation systems used to control the environment for the plants and describe <br />how such systems operate with the systems preventing any odor leaving the premises. For <br />businesses that produce cannabis-infused products, such plan shall also include all ventilation <br />systems used to mitigate noxious gases or other fumes used or created as part of the <br />production process
