MINUTES <br />CITY COUNCIL <br />October 25, 1989 <br />Blesener pointed out that if the City is the owner of <br />the project, the project would probably have to be let <br />out for bid. <br />The City Attorney assumed so. <br />Fahey pointed out that if Barthel Construction is the <br />owner of the project, the project would not have to be <br />let out for bid. Fahey again pointed out that if the <br />City assists the project with TIF, Barthel Construction <br />would be the owner, but the City could retain control <br />throuqh the development agreement. <br />Cohodes summarized that the City would like Barthel <br />Construction to undertake a preliminary market study <br />and present its results to the Council. The Council <br />would like Miller & Schroeder to wait until the new <br />City Administrator is on board, and then the Council <br />will decide which consultants Miller & Schroeder should <br />work with on the project. <br />Fahey reported that a workshop meeting would be <br />scheduled at the time the market study is available. <br />RoUND LAKE Mr. Jay McNabb, attorney representing the Round Lake <br />TRAIL Trail Homeowners Association, appeared before the <br />HOMEOWNERS Council to discuss the issue of the retaining wall at <br />ASSOCIATION the complex. McNabb reviewed the history of the <br />retaining wall which needed to be shored up in 1988 <br />because it was crumbling. McNabb reported that <br />eventually Mr. Schrier did shore up the wall at the <br />City's insistence, however, it was not a permanent <br />solution to the problem. McNabb reviewed various <br />reports submitted by the Building Inspector, DNR and <br />Watershed on the situation, pointing out that the <br />conclusion was that the wall is crumbling and <br />eventually homes will end up in Round Lake if the wall <br />is not repaired. <br />McNabb requested that the Council have City staff again <br />look at the retaining wall to determine if Mr. Schrier <br />has complied with the terms of the development <br />agreement the City has with him. <br />The City Engineer recalled that he looked at the wall <br />in 1988 and to his knowledge Mr. Schrier did make some <br />repairs in the wall. The City Engineer reported the <br />DNR and Watershed's concerns are that dirt is washing <br />into the lake due to the crumbling retaining wall. <br />Page 23 <br />
