MINUTES CITY COUNCIL NOVEMBER 22, 1989 RESOLUTION NO. 89-11-566 - PLACING A MORATORIUM ON THE ENFORCEMENT OF ORDINANCE NO. 322, SECTION 816.040 (B), WITH REGARD TO CHARGING A$500.00 USER FEE FOR FALSE BURGLER ALARMS IN EXCESS OF SIX, PENDING FURTHER REVIEW AND ADOPTION OF CHANGES TO THE CITY'S FALSE ALARM ORDINANCE AS APPLIES TO BURGLAR ALARMS The foregoing resolution was duly seconded by Mrs. Scalze. Ayes (4) Fahey, Scalze, Collova, LaValle. Nays (1) Blesener. Resolution declared adopted. Blesener stated that he would like to look at the fees for false fire alarms as well ,and voted against the resolution since he felt the $250 false alarm fee was also too high. Fahey instructed City staff to get copies of the false alarm ordinances that are currently in effect in other cities, and suggested that the City Administrator analyze them and report back to the Council. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 89-11-567 - INSTRUCTING THE CITY ADMINISTRATOR TO ANALYZE TIiE FALSE ALARM ORDINANCES OF SURROUNDING CITIES, AND MAKE A RECOMMENDATION TO THE COUNCIL ON TfiE ISSUE OF FALSE BURGLAR ALARM FEES AT THE DECEMBER 27, 1989 COUNCIL MEETING The foregoing resolution was duly seconded by Mr. Blesener. Ayes (4) Fahey, Blesener, Scalze, Collova. Nays (1) LaValle. Resolution declared adopted. ON-SALE Fahey reported that State Law has been changed to allow LIQUOR the holders of on-sale liquor licenses to stay open HOURS OF until 1 a.m. on Monday mornings. Fahey noted that the OPERATION City has receiv ed letters from the holders of on-sale licenses within the City supporting the City's adoption of an ordinance allowing the increase in hours of operation. The City Attorney reported that the State Law also allowed cities to permit the holders of off-sale licenses to be open on Fourth of July and New Year's Day. Page 11
