MINUTES <br />CITY COUNCIL <br />January 10, 1990 <br />CITY Fahey reported that there has been a meeting of the <br />ENGINEER City Engineer Search Committee, and it was decided that <br />SEARCH the City Administrator should solicit proposals from <br />four or five different engineering firms and determine <br />how these firms would propose to provide services to <br />the City. Fahey reported that proposals will be sought <br />from both medium-sized and small firms. <br />Fahey also reported that the Committee has decided that <br />it is not necessary to have the City Engineer present <br />at every Council meeting, and that meetings could be <br />structured so that the Engineer only has to attend one <br />meeting per month, similar to what is done for the City <br />Planner. <br />NAEGELE The City Attorney reported that he has research the <br />SIGN issue of billboards raised at the last Council meeting, <br />and the majority of litigation in this area has <br />involved Naegele. The Attorney stated that City <br />ordinance says that non-conforming signs created by the <br />Zoning Ordinance must be removed or brought into <br />conformity within five years from enactment of the <br />Ordinance. That five-year period has come and gone. <br />The Attorney stated that if the City wishes to force <br />the issue, it can anticipate paying moving costs and <br />pointed out that, to date, the courts have considered <br />signs as personal property. There may also be <br />compensation to the leasor depending on the lease <br />agreement, however, the Attorney pointed out that he <br />does not have access to those leases. <br />Fahey pointed out that there does not appear to be a <br />lot of exposure with regard to the lease Naegele has <br />with MN Mini-Storage as the owner reported that the <br />lease is a 20-year lease with a lease amount of $1 per <br />year. <br />Collova stated that he did not support a legal battle <br />to get the billboard removed and pointed out that he <br />has not heard any negative comments from citizens about <br />the billboard. <br />Fahey stated that if the Council feels the billboard <br />should be allowed to remain, then the Ordinance should <br />be amended making billboards permitted uses. <br />Blesener disagreed, stating that he does not want to <br />see any new billboards erected in the City. <br />Page 16 <br />
