MINUTES <br />CITY COUNCIL <br />January 10, 1990 <br />LaValle did not support spending a great deal of money <br />in legal fees to get the billboard down. <br />The City Attorney stated out that most of the legal <br />cases involving billboards involve Naegele as well, <br />pointing out that Naegele will not walk away from the <br />matter. The City Attorney reported that the City will <br />need a court order to get the billboard removed, and <br />once civil action is started against Naegele, the City <br />cannot control what the opposition does. <br />Scalze asked if any other city has tried to enforce a <br />sign ordinance with a sunset clause, similar to Little <br />Canada's ordinance. <br />The City Attorney stated that he could look at the <br />facts in the other cases. <br />Scalze stated that she was not in favor of spending a <br />lot of money to get the billboard removed, however, if <br />it is not removed, she would not support an ordinance <br />change making billboards a permitted use. Scalze <br />pointed out that there are actually three billboards in <br />the City. <br />Collova pointed out that the City has no knowledge of <br />the terms of the leases for the other two billboards in <br />the City. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 90-1-20 - INSTRUCTING THE CITY ATTORNEY <br />TO REVIEW LEGAL CASES REGARDING THE REMOVAL OF <br />BILLBOARDS AND DETERMINE THE COSTS INVOLVED IN THESE <br />CASES, AND INSTRUCTING CITY STAFF TO OBTAIN COPIES OF <br />THE LEASE AGREEMENTS WITH NAEGELE FOR THE THREE <br />BILLBOARDS LOCATED WITHIN THE CITY OF LITTLE CANADA <br />The foregoing resolution was duly seconded by Fahey. <br />Ayes (3) Scalze, Fahey, Blesener. <br />Nays (2) Collova, LaValle. <br />Resolution declared adopted. <br />Blesener pointed out that the lease for the billboard <br />located on the MN Mini-Storage property may only have a <br />few years left to run. <br />Page 17 <br />
