MINUTES <br />CITY COUNCIL <br />APRIL 25, 1990 <br />Scalze was concerned that should the property be sold <br />in segments, that the Council have review and approval <br />of ingress and egress agreements. <br />Blesener pointed out that a lot split would be required <br />in order for the property to be sold in segments, thus <br />ensuring that the Council would have controle <br />Fahey asked if approval of the amended PUD Agrement <br />would impact the City's ability to enforce the PUD <br />Agreement or City Ordinances. <br />The City Attorney stated that there would be no impact. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION N0. 90-4-211 - APPROVING THE REVISED TWO S <br />PROPERTIES PUD AGREEMENT BASED ON THE CITY ATTORNEY'S <br />REPORT DATED MARCH 23, 1990 AND AUTHORIZING THE MAYOR <br />AND CITY ADMINISTRATOR TO SIGN THE AGREEMENT ON BEHALF <br />OF THE CITY <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (5) Fahey, Blesener, Collova, Scalze, LaValle. <br />Nays (0). <br />Resolution declared adopted. <br />SHOULDER Blesener reported that the shoulder paving improvements <br />PAVING - proposed by the County for County Road D and Little <br />COUNTY RD. D Canada Road include regrinding the street as well as <br />& LITTLE overlay. Blesener pointed out that in the case of <br />CANADA ROAD Little Canada Road, the County has it in their plans to <br /> totally reconstruct the street with curb and gutter in <br /> 1995 if the overlay does not occur. However, if the <br /> overlay occurs, the reconstruction improvement will be <br /> placed in the County~s 12-year cycle and may not occur <br /> for the next 15 to 20 years. Blesener reviewed the <br /> Public Works Superintendent's recommendation not to <br /> overlay, but to request the reconstruction of Little <br /> Canada Road. <br />Council agreed with that recommendation. <br />The City Engineer also supported the reconstruction of <br />Little Canada Road rather than overlay improvement. <br />The Engineer suggested that the County be informed that <br />it is the feeling of the City that the overlay is not <br />in its best interests at this time. <br />Page 13 <br />
