MINUTES <br />CITY COUNCIL <br />May 9, 1990 <br />disallow 12 children in a day care center in an R-1 <br />area. <br />The City Attorney replied that that was his <br />understanding, however, reported that State Law may <br />have changed to allow up to 16 children. The Attorney <br />reported that he would look at the State Law. <br />Fahey pointed out that the City's current Code allows <br />12 or fewer children as a permitted use in an R-1 area. <br />Collova stated that 12 children seems like a lot to him <br />and he was opposed to allowing Hennessey to have up to <br />14. Collova pointed out that the area is not totally <br />developed as yet. Collova felt that if the concensus <br />of the Council was to allow 14 children, the CUP should <br />be reviewed annually. <br />Fahey agreed that 14 children was a lot and suggested <br />that a large day care facility should be located in a <br />commercial area. <br />Collova pointed out that this day care center is a <br />business. Collova stated that while this center was in <br />a good location, if the City approves the CUP, it will <br />not be able to turn down a similar request in a more <br />developed area. <br />Council decided to move on to other agenda items until <br />the City Attorney located the State Law that refers to <br />this issue. <br />FIRE DEPT. Fahey reviewed the City Administrator's letter dated <br />CONTRACT May 4, 1990 which indicated that the City cannot <br />provide Errors and Ommissions coverage for the Fire <br />Department since it is a separate corporation, and has <br />never done so in the past. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 90-5-231 - APPROVING THE 1990 FIRE <br />DEPARTMENT CONTRACT AND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE THE CONTRACT ON BEHALF OF THE <br />CITY, AS WELL A5 INSTRUCTING THE FIRE DEPARTMENT TO <br />MAKE THEIR OWN DETERMINATION AS TO ERRORS AND OMISSIONS <br />INSURANCE COVERAGE <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Blesener, Scalze, Collova, Fahey, LaValle. <br />Nays (O).
