MINUTES <br />CITY COUNCIL <br />May 23, 1990 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Scalze, Collova, Fahey. <br />Nays (O). <br />Resolution declared adopted. <br />KROISS Council reviewed the application submitted by Mr. Ray <br />SUBDIVISION Kroiss for subdivision of a small triangular piece of <br />property from Lot 2, Block 1, Gervais Lake Second <br />Addition, and attaching it to Lot 1. It was noted that <br />the Planning Commission tabled action on this request <br />since there was no one present to answer some questions <br />that they had. <br />John Daubney, attorney representing Mr. Kroiss, <br />requested that the Council approve the subdivision <br />contingent upon approval of the Planning Commission. <br />Daubney reported that the property division being <br />requested follows the natural separation of the <br />property due to a wall which runs through the property <br />as well as a drainage easement. Daubney also pointed <br />out that the division will improve the access for Lot 2 <br />pointing out the topography of the property. Daubney <br />reported that no variances are being requested and both <br />lots will exceed minimum lot size requirements. <br />Scalze stated that her only question had to do with the <br />retaining wall and access to the rear portion of Lot 2. <br />The Planner stated that this was his concern as well, <br />pointing out the height of the retaining wall and the <br />need for the owners of Lot 2 to be able to maintain the <br />rear portion of their property. The Planner pointed <br />out that access could be provided via a stairway <br />through the wall. <br />Daubney reported that it would not be expensive for the <br />property owner to install a stairway through the wall <br />pointing out that the height of the wall is 4 feet. <br />Daubney pointed out that the triangular piece of <br />property the applicant wishes attached to Lot 1 is high <br />ground and will provide driveway access for the lot. <br />There was no one else from the general public present <br />wishing to comment on this matter. <br />Page 2 <br />
