MINUTES <br />CITY COUNCIL <br />JUNE 12, 1990 <br />return for deed restrictions on the property declaring <br />that the property could not be divided. <br />The City Attorney suggested that the City could abate a <br />portion of the Eriokson watermain assessment and should <br />at some time the property be subdivided, the assessment <br />could be collected at the time of subdivision. The <br />only concern is that City staff would need to monitor <br />this. The Attorney pointed out that drawing up deed <br />restrictions requires a lot of time and money. <br />Fahey pointed out that should the City decide that a <br />deed restriction is the way the matter should be <br />handled, the property owner would have to pay the cost. <br />Fahey pointed out that the Erickson's did not raise <br />their concerns at the time of the assessment hearing <br />when the matter could have been handled easily. Fahey <br />stated that he did not want to rely on staff <br />remembering the matter several years from now if a <br />property division is requested some time in the future. <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 90-6-278 - ABATING THE ERICKSON <br />WATERMAIN ASSESSMENT FOR GREENBRIER STREET, INCLUDING <br />PRINCIPLE AND INTEREST PAID IN THE AMOUNT OF $4,508.60 <br />THROUGH 1990, CONDITIONED UPON THE OWNERS OF THE <br />PROPERTY AGREEING TO A RESTRICTIVE COVENANT DECLARING <br />THAT THE PROPERTY IS NOT SPLITABLE FOR FUTURE <br />DEVELOPMENT, CONDITIONED UPON THE PROPERTY OWNER PAYING <br />THE AMOUNT TO BE ESTABLISHED BY THE CITY ATTORNEY AND <br />CITY ADMINISTRATOR AS REASONABLE ATTORNEY~S FEES FOR <br />COSTS INVOLVED IN PREPARING THE RESTRICTIVE COVENANT <br />WITH TAIS AMOUNT TO BE DEDUCTED FROM THE ASSESSMENT <br />PRINCIPLE AND INTEREST TO BE REFUNDED, AND SHOULD THE <br />PROPERTY OWNER WISH TO DIVIDE THE PROPERTY IN THE <br />FUTURE~ THE PROPERTY OWNERS WOULD BE RESPONSIBLE FOR <br />PAYMENT OF PRINCIPLE AND INTEREST FOR THE WATERMAIN <br />ASSESSMENT PREVIOUSLY LEVIED FOR GREENBRIER THROUGH THE <br />LIFE OF THE BOND ISSUE <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Scalze, Collova, Blesener. <br />Nays (0). <br />Resolution declared adopted. <br />FIRE STATION Council reviewed the tentative schedule for the Fire <br />CITY CENTER Station/City Center projects. <br />PROJECT <br />SCAEDULE.
