MINUTES <br />CITY COUNCIL <br />JUNE 27, 1990 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (4) Blesener, LaValle, Collova, Fahey. <br />Nays (1) Scalze. <br />Resolution declared adopted. <br />Scalze felt this action would make the City's Sign <br />Ordinance inconsistent with other cities, pointing out <br />that the Planner's research showed that 5 of the 6 <br />cities surveyed required a separate parcel of property <br />in order for a detached building to be allowed its own <br />pylon. <br />Blesener stated that he would accept the Planner's <br />interpretation that the situation is the same whether <br />or not there is a separate parcel for the free-standing <br />building. <br />JACKSON Mr. Paul Borg, 2370 Jackson Street, appeared before the <br />STREET IMP. Council expressing concern that when Jackson Street was <br />& ST. JUDE'S improved in the early 1980's part of the right-of-way <br />BUFFER for the street encroached into the 100-foot buffer zone <br />for St. Jude's Medical. Borg stated that he thought <br />that when the right-of-way was taken, the buffer zone <br />was adjusted accordingly. However, he was surprised to <br />learn last week when development began on the St. <br />Jude's expansion, that the street right-of-way was in <br />the 100-foot buffer zone. <br />Scalze pointed out that the intent of the buffer zone <br />was to ensure that there would not be development <br />within 100 feet of the property line. Scalze stated <br />that she had no problem with the fact that the street <br />riqht-of-way is within the buffer zone. <br />Fahey pointed out that the road was dedicated after the <br />buffer zone was in existence. At the time the buffer <br />zone was established, no one envisioned the street <br />developing. Fahey pointed out that when the street <br />improvement was proposed, it was necessary to take 25 <br />feet of additional road right-of-way from St. Jude's. <br />Fahey pointed out that this street serves the Borg home <br />as well as one other. <br />Blesener pointed out that if the City would have <br />required the buffer to be expanded to accommodate the <br />road right-of-way, St. Jude's would not have been <br />willing to dedicate the road right-of-way. <br />Borg felt that he should have been informed that the <br />buffer zone was decreased. <br />Page 20 <br />
