MINUTES <br />CITY COUNCIL <br />JULY 11, 1990 <br />to require some of these residents to move the piles to <br />the curb. LaValle suggested that Precision Tree be <br />instructed to pick up the piles. <br />Council discussed this suggestion and it was their <br />consensus that if a hardship can be established to the <br />satisfaction of the City Administrator, Precision Tree <br />be instructed to pick up the piles not adjacent to the <br />curb. However, it will be the property owner's <br />responsibility for any damage that might occur to <br />driveways or lawns. <br />The entire Council commended the Public Works staff for <br />the job they did Sunday of clearing streets and <br />monitoring utilities during the power outage. <br />EAGAN The City Administrator reported that he is in the <br />A5SESSMENT process of researching the details of the Eagan <br />property assessment for Minnesota Avenue, and there are <br />some definite concerns as to how the assessment was <br />levied. Previous minutes reflect discussion about some <br />of the property being unbuildable. A portion of the <br />assessment was levied and a portion was deferred. <br />The Administrator reported that he would like to <br />discuss the matter with the previous City Engineer, who <br />is currently out-of-town, but will be returning within <br />the next few days. White it appears that assessments <br />are worthy of abatement, the Administrator reported <br />that he would like to discuss the situation with the <br />former City Engineer before making a final <br />recommendation. <br />Fahey pointed out that should the assessments.be <br />abated, the City would require that the property owner <br />agree to a deed restriction which would declare the <br />property to be unbuildable. <br />Mrs. Eagan asked if she would still be responsible for <br />payment of property taxes if the property were declared <br />unbuildable. <br />Fahey replied that the property would continue to be <br />taxed just as other unbuildable parcels are taxed. <br />Scalze pointed out that the property owner has the <br />option not to pay those property taxes which would <br />result in the property going tax-forfeit to the County <br />and either sold for back taxes or retained as open <br />space. a <br />Page 3 <br />
