MINUTES <br />CITY COUNCIL <br />AUGUST 8, 1990 <br />Blesener pointed out that Slumberland could pay the <br />entire cost, and if Lots 14, 15, or 16 connected to the <br />watermain the property owners could pay their share at <br />that time. Blesener asked if the alternative gave <br />Slumberland an ample water supply and looped the <br />system. <br />The City Engineer replied that it did. <br />Paul Kaufman, representing Slumberland, reported that <br />Slumberland would be willing to pay the entire cost of <br />the Engineer's alternative since they would be the only <br />one using the line. <br />Fahey agreed with Blesener's suggestion that should <br />Lots 14, 15, or 16 connect, they would be assessed <br />their fair share of the cost of the watermain at that <br />time, and Slumberland would be reimbursed. <br />Blesener pointed out that the lots will probably <br />develop backing up to the industrial park. Should that <br />happen, Noel Drive would be extended and watermain <br />would be looped through Noel Drive and up to County <br />Road D. <br />The City Engineer pointed out the existence of a large <br />oak tree in the street right-of-way for DeSoto Street. <br />The Engineer suggested that the watermain could be <br />placed as far east as possible so that it does not <br />damage the root system of the tree. There may be the <br />need for a construction easement, however, from the <br />property owners to the east. <br />It was pointed out that the tree is registered with the <br />State Historical Society, therefore, the tree cannot be <br />disturbed. <br />One property owner to the east expressed concern that <br />the easement would be very close to her home. <br />Fahey felt the City should try to work around the tree <br />and in order to do this, cooperation from the adjacent <br />property owners is necessary. <br />One resident of the area stated that he would like to <br />see the tree preserved. This resident was also <br />concerned that the landscaping that Slumberland has <br />been required to do on their property has not yet been <br />done. He was told that Slumberland was waiting until <br />the watermain extension was completed. <br />Page 5 <br />
