MINUTES <br />CITY COUNCIL <br />AUGUST 8, 1990 <br />Fahey agreed, and stated that if the City has a chance <br />to correct the situation, it should do so. <br />Blesener pointed out that there are not the votes <br />necessary to support the variance request. Therefore, <br />Blesener felt Stewart should discuss the costs with the <br />adjacent property owners to determine if they are <br />willing to pay for the street. Blesener asked about <br />construction of a house over the sanitary sewer <br />easement. <br />The City Engineer recommended that Stewart not be <br />allowed to build over the easement. The Engineer <br />reported that the Building Inspector has worked out a <br />couple of arrangements whereby a house could be <br />constructed on the property without encroaching onto <br />the easement. <br />Stewart pointed out the statement from the previous <br />City Attorney stating that the property is buildable. <br />The City Engineer agreed that the documents Mr. Stewart <br />has may give him some rights to build on the easement. <br />Stewart asked if the cul-de-sac were improved, if the <br />City would vacate the right-of-way for Rose Place. <br />Scalze felt that would be a possibility, noting that <br />such a vacation would give land to the property owners <br />abutting the right-of-way. <br />Stewart asked if the curb and gutter and the cul-de-sac <br />could be eliminated. <br />It was pointed out that there appears to be only three <br />members of the Council that would support this deviance <br />from City standards, and four votes would be required. <br />Stewart reported that the Buche driveway already is <br />surfaced with Class V materials. <br />The City Engineer replied that if a street were <br />improved, that material would be dug out, stockpiled <br />and reused, if possible. <br />Stewart felt that curb and gutter should not be <br />required. <br />Blesener suggested that Stewart be allowed to put in a <br />residential driveway to serve the lot provided that he <br />and Buche are responsible for all maintenance. <br />Page 9 <br />
