MINUTES <br />CITY COUNCIL <br />AUGUST 22, 1990 <br />Blesener expressed concern that the property owner at <br />the northeast corner of proposed Noel Drive and Al1en <br />Avenue did not dedicate the 20 foot easement. Blesener <br />asked where Noel Drive, if improved, would lie in <br />relation to the house. <br />Mrs. Plessel, 490 Allen Avenue, stated that she was <br />aware of the possible road easement when she purchased <br />her property, and placed her home accordingly. <br />Scalze asked what the chances of the City's obtaining <br />the easement were based on the old resolution dividing <br />the property. <br />The City Attorney replied that they were nil. <br />Fahey pointed out that the property owner has <br />acknowledged that she was aware of the road easement. <br />It was the previous City Attorney who did not follow up <br />in obtaining and recording the easement. <br />Mrs. Plessel indicated that she was told about the 30 <br />foot easement, which has now been reduced to 20 feet. <br />Plessel stated that she was in favor of Noel Drive <br />going through, however, was not planning on donating <br />any land to the City. <br />The City Attorney reviewed his letter dated July 9, <br />1987 in which he indicated that Mrs. Plessel expects to <br />be compensated for the road easement. <br />Fahey pointed out that this cost would be spread over <br />the cost of the project. <br />Blesener asked if any of the southern property owners <br />were in favor of Noel Drive going through to LaBore <br />Road. There was 100% opposition. <br />DeBace pointed out that the proposal of extending Noel <br />Drive to the southern portion of the Costa property and <br />then over to DeSoto, cuts off the possibility of the <br />properties on the south developing in the future. <br />Fahey pointed out that ending Noel Drive in a temporary <br />cul-de-sac that could be extended in the future would <br />resolve that concern. Fahey asked if any of the <br />property owners objected to the proposal of extending <br />Noel Drive from Allen and looping the street over to <br />DeSoto, which had the possibility of precluding <br />development of the southern lots in the future. <br />Page 12 <br />
